Re: Question about on-line notice for 30.06 (3) (A)

My analysis is that the website for a church, apparently set up by the church, provides information and policies by the owners and people authorized by the owners. If you take the time to read the site, and click through to the weapons policy (nothing haphazard about that, you did it), and read the...

Re: How to check if a premise is 51%?

...Why do this? It also seems obvious the the point of making this endurance is to allow you to effective comply with the prohibition in 46.035. Now, if this is true...it follows that if a prosecutor can prove that you were already in a state of knowledge of the 51% status of the business then the ...

Re: Question about on-line notice for 30.06 (3) (A)

My analysis is this... 30.05, 30.06, and 30.07 require SIGNAGE to be placed conspicuously and clearly visible to the public. It would seem that the purpose for this is to ensure that the person to who the prohibition applies actually gets the message. There is an implied "you can't reasonably o...

Re: using deadly force

You can not use deadly force unless you are threatened by deathly force, so an example is a guy enters your house with a banana in his hand, you can not shoot him. The principle of proportional force prohibited and you will be going to jail. That sounds like legal advice. Are you licensed to practi...

Re: How to check if a premise is 51%?

.... While you are technically correct, one thing to remember is this is a 'defense to prosecution', but not a guarantee you won't be prosecuted. For example, if the prosecutor can convince the Judge or Jury that you well knew it was a 51% location when you entered, even without the sign, then you ...

Re: "Gun-Buster" Sign Legal?

Gun buster signs have zero legal force. They mean nothing to you as an LTC. Nothing. Except to inform you that the owner apparently doesn't want guns in his establishment. Not necessarily. Let's say you see this sign posted somewhere: https://i.imgur.com/WhwgNzu.jpg Does it mean: 1. "The owner...

Re: Gun Buster Signs

"Gun-buster" refers to the gun in a circle, the intl symbol for no guns. By itself, it has no legal status in Texas. "No guns", "no weapons", "no firearms", etc. are all non-conforming signs, and have no force of law in Texas, including with knives. I disagre...

Re: Leaving gun in car?

If the theory is that a thief won't bother with part of a gun......I wouldn't count on that. If it IS true the simply putting the slide in a different hidden place in the car.

Or put it in a locked attached box.

Re: Gun rights for a Felon?

The felon hasn't served his sentence. That's where the confusion is. His sentence is...to spend 10 years in prison (or whatever) AND lose the right to own a gun except for a very restricted case. That's the sentence. He continues to serve his sentence for the rest of his life. The same would be true...

Re: Fredericksburg Trade Days

There were no signs anywhere that I saw this past weekend. Saw one man open carrying without anyone paying him any mind. Thanks for the input. I bet that was me! I was there over the weekend and I was the only oc I saw. Which means I was probably the guy most people mean when they say they saw some...

Re: another 30.06 question

Tex - Thank you for a very informative post. I think the confusion arises from things like a "circle / slash" sign. To me, such a sign is the pictorial equivalent to the words "No ___ allowed", or even "No ____". Per your above, then, that would not provide sufficient ...

Re: another 30.06 question

There have been several posts since my last. A few of these as well am many of the original 5 pages of posts makes me think that I may not be making my point well or clearly and that the main point about all of this issue is being missed. A sign, any sign, that says things like "No Weapons allo...

Re: another 30.06 question

Nor have I.

I thinks it's because of a complete lack of knowledge on the part of owners who want to actually prohibit entry but who don't understand 30.05 well enough to do it In a way that will stand the test of the legal system.
