Re: Daycare and Pre-Schools

Most pre-schools have kindergarden and require the same immunizations, paperwork, and documentation you would need to attend an accredited elementary school. A prosecutor could make a convincing argument and a jury would find it reasonable to consider a pre-school facility an educational institutio...

Indeed, which is why the piece is simultaneously amusing, instructive, and a bit scary.

Re: Is it legal? Sign split in two...

An interesting issue is if you see a sign and do puzzle out that it is correct sign in terms of wording, I doubt your arguments about contrast and color would hold up as you have admitted to noticing its meaning. The statutory wording pretty clearly sets out a contrary standard. But nothing in life...

Re: Is it legal? Sign split in two...

the penalty [for speeding] is also higher when you consider insurance and other increased costs. Well, you can take defensive driving. Sometimes apart from that, you can get deferred adjudication. That keeps the ticket off your record and thereby avoids bad insurance consequences. As for fees and f...

Re: Is it legal? Sign split in two...

The way I am reading the law, I do not think a sign split (into anything other than one complete sign,) would be in compliance with the law. A respectable argument, no doubt one most judges would listen to and consider. Whether it's consistently a winning argument is less clear to me. I intend to t...

Let's be glad it was his foot that got shot and not somebody else's foot or worse.

D.C. Circuit Upholds RTKBA

Before Heller, D.C. required a firearm owner to have a license to carry a firearm from one room of the owner's home to another. After Heller, D.C. magnanimously let gun owners move their weapons around the house. Now, the federal appeals court has told them that the right to bear arms means you shou...

Re: HB 560 - Holy Grail?

Well, your LTC is quickly available on SOME database. About 2 years ago, my wife and I went to a U.S. Air Force base as visitors. When we were checking in at the front gate office, the guy behind the counter took my driver's license, typed something into a computer and immediately said, "he's ...

Re: HB 560 - Holy Grail?

The bottom line is you think the Second Amendment prohibits the requiring of a license to carry a firearm. The SCOTUS has not held this to be true and it has strongly indicated in Heller that licensing is constitutional. Chas. Absolutely. Some people refuse to face the obvious. Wesley Snipes contin...

Re: Oklahoma man kills neighbor who was allegedly trying to drown his twin babies.

I don't think three bullets would have been enough for me. I would have had to reload a few times, and possibly go purchase more ammo. A situation so urgent you had to leave the scene, purchase more ammo, and return for more shooting? That might require a little more creativity on the part of your ...

Here's another account. It looks like the prosecutor agrees the situation required shooting. https://www.washingtonpost.com/news/volokh-conspiracy/wp/2017/07/08/man-who-shot-neighbor-for-attempting-to-drown-children-will-not-face-charges/?utm_medium=facebook&utm_source=dlvr.it&utm_term=.94d6...

Re: Federal Judge blocks CA magazine ban

If California banned cis het males starting 1/1/2018, that might be upheld by the Ninth Circus. However, if the courts overturned the law it would be for some reason other than ex post facto because such a law wouldn't be so. Yes, whatever the problems might exist with that law, it would not be ex ...

Re: Democrat Mayor disses dead cop

Yet another example. Democrats don't just disagree on how to achieve freedom and prosperity. For them, freedom and prosperity take a backseat to increasing government power over our lives. They are on the other side.
