Re: NRA Endorses Dade Phelan
I will still renew my membership, if for nothing else to get into the convention in Houston. But this is a reason why I don't think the NRA has been an effective organization recently.

Re: Spare magazine owb at posted business
The state of Texas defines a firearm as any device made or adapted to expel a projectile through the use of a burning or explosive substance. A 30.07 restricts carrying a firearm by a license holder openly. A magazine holder is no a firearm so no, in my opinion carrying a magazine holder past a 30....

Re: Frustration at 30.06 signage
Not to quibble with Steve's post, and see my longer discussion I just posted, but with regards to the Defense to Prosecution, I disagree slightly. A defense does not have to be negated by the DA and is only submitted to the jury if the defendant provides evidence of the defense. And to win, the def...

Re: Frustration at 30.06 signage
I agree with you for real world applications, but for technical legal discussions there is a real difference. From a technical legal viewpoint, if you did not break the law then no crime occurred. If a crime did not occur, you cannot be indicted and tried. The fact that you can be arrested and trie...

Re: Frustration at 30.06 signage
About Defense to Prosecution. If you read the Texas Statutes Penal Code Chapter 2, it's first section states. PENAL CODE TITLE 1. INTRODUCTORY PROVISIONS CHAPTER 2. BURDEN OF PROOF Sec. 2.01. PROOF BEYOND A REASONABLE DOUBT. All persons are presumed to be innocent and no person may be convicted of ...

Re: Frustration at 30.06 signage
Hey, I understand.... And I agree the laws are quite confusing. I've been pouring over the ODFR presentation and honestly it has some contradictions. This is way past my training for sure. I might try and contact the DPS training department next week and get a clarification myself. I've been pourin...

Re: Frustration at 30.06 signage
Get a Red Cross CPR card. That's what I did so I can ignore 30.06 signs starting 9/1. ❄ If I was on the jury, I'd do my best to get you an acquittal, but, IMO a CPR card doesn't meet the volunteer definition. I'm not going to ask for the AG to give an opinion, but being a test case can be expensive...

Re: New Problem! M1A or M1 Carbine
I was so shocked at seeing the Carbine that I didn't check anything about it. I didn't look to see what year it was stamped with or anything other than the price. Next time I'm there I'll do a more thorough inspection and ask about some details. If it is WWII era for sure then it's coming home with...

Re: Underage Question
The question is: May a Non-resident that is 18-20 obtain a Texas Non Resident LTC? As in a college student going to college in Texas. My opinion is yes. I have not read or seen anything otherwise. But remember, there is a good possibility that they may not have legal status outside of Texas. Also r...

Re: Texas State Fair Carry Rules
License to Carry a Handgun The State Fair of Texas is—and always has been—a private entity. The Fair leases the Fair Park property from the City of Dallas but is not part of the City or controlled by a government body. The State Fair of Texas has long been, and continues to be, a strong supporter o...
