“The testimony confirming Perry's anger toward protesters came on the third day of the trial as prosecutors displayed text messages and social media comments showing that he thought about killing them. "I might have to kill a few people on my way to work, they are rioting outside my apartment complex," Perry wrote to a friend in June of 2020. "I might go to Dallas to shoot looters," he wrote on another occasion. Perry also encouraged violence in a variety of social media posts.

In addition, Perry speculated about how he might get away with such a killing – by claiming self-defense, as he is now doing. Prosecutors presented a Facebook Messen­ger chat between Perry and a friend, Michael Holcomb, which occurred two weeks before he shot Foster. In it, Perry argued that shooting protesters was legal if it was in self-defense. Holcomb, who was called to the stand Wednesday afternoon, seemed to try to talk Perry down. "Aren't you a CDL holder too?" he asked, referring to the men's licenses to carry concealed handguns. "We went through the same training ... Shooting after creating an event where you have to shoot, is not a good shoot."”

This was in an Austin newspaper.

This was on Yahoo about a shooting after a car accident in Dallas.

Again two people with guns. One apparently drunk.

The trial that should not have happened, has started in Austin.

This may determine if Austin is really part of Texas and if the Capital of Texas needs to be moved.

Apparently the Sargent tweeted things on social media that present a view that is not helpful should he be charged with a crime, supposedly. The post were under a screen name, but a communist website has linked it him. The posts have since been taken down.

"In June, when President Donald Trump tweeted that "protesters, anarchists, agitators, looters or lowlifes" protesting in Oklahoma would face "a much different scene" than protesters in New York or Minneapolis, Perry responded from a now-deleted account with the username “@knivesfromtrigu”. The tweet read, "Send them to Texas we will show them why we say don't mess with Texas." That account was identified as being connected to Perry by Tribune of the People, which bills itself as a “revolutionary news service.”"

Breaking this video down, Foster felt it was his "right" to march in the streets and block traffic... wanted to kill cops with his AK, but knew he would die if he did... and was actively intending to intimidate anyone who disagreed with ANTIFA/BLM. Now he's a dead terrorist.
So is this guy a candidate for the eye test. Looks like it to me.

So. Foster is participating in action forcibly impeding the transit of the driver. IANAL, but I suspect that the rifle qualifies this as forcible restraint, even though its a car vs. pedestrian scenario.

The driver, has no option of escape, other than to drive through the (not visibly armed) crowd.

Foster made public statements, contemporaneous to the event, that demonstrate an aggressive and confrontational mindset.

Now, if the driver had no "reasonable business" there, e.g., did not live/work in the area, their presence at the scene could be problematic.

If they do have "reasonable business", then the presence of an aggressive armed individual, in the midst of a mob, is reasonably seen as a threat.

I would be curious about his AF time. He has the smell of an unfulfilled GI Joe, traipsing his fiance out in an almost baiting fashion, trying to create a scenario in which he could "defend" her.
Austin has an interesting traffic pattern. Lots of highways go North/South, not much East/West. It seems every time I’m in Austin I’m exiting I 35 and driving through downtown to head West. My memory the streets are one way and I think I always try and avoid 6th street since it’s always so busy. I think this occurred on 4th street.

So to me it was very easy for this guy to be just a guy trying to get through downtown to go West or East to get to I-35.
