Bibb County Sheriff David Davis said a burglar fleeing a female resident turned around and shot “back into the house,” striking his burglary accomplice in the head and killing him on the spot.

According to The Telegraph, the two suspects were running one behind the other. The one in the lead had the gun and the one following had a television set that he dropped after being startled by the female homeowner.

The suspect who was shot “died in the threshold of the woman’s front door.”

According to the article, this happened in morning hours. Police showed up at 10am. If it had happened a few hours earlier (and in Texas), could the thief with the gun could use Sec. 9.42 (2) (B) as a defense?
DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property: (2) when and to the degree he reasonably believes the deadly force is immediately necessary: (B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property
Okay, I know he would never get away with it. But it makes for an interesting thought exercise as to what a desperate defense lawyer might try.
