Running out soon, don't have time to find a link, but I was watching TXCN (Texas
Cable News).

They said that the guy who killed the Pasadena, TX cop in August 2009 had just purchased his
Smith and Wesson handgun, model unspecified, 2 weeks before the murder, from a
sporting goods store.

He passed the background check even though he had ongoing mental problems. Apparently
there are different kinds of legal proceedings regarding mental issues.

The killer had the kind that is not reported, hence, he passed the background check.

Sad loophole. The thin blue line that protects good people has just gotten a little thinner in Pasadena.

This issue is a distraction.

Even if the guy had been branded on his forehead to prevent him from buying a firearm through legal channels, he could have obtained one by whatever methods felons, illegal aliens, minors, and residents of places like Washington D.C. and Chicago use.

Isn't that the point the OP is making? Some criminals DO buy retail?

The problem is that he is not a criminal. He's mentally handicapped.

Harris County Probate Court says that information is restricted and not shared without a court order, despite the fact that the information would keep guns from being illegally sold. "

You know, we might all be jumping to conclusions without accurate reporting. The article says he was committed. The law forbidding firearms sales uses the term adjudicated mentally defective. There is a world of difference between the two. Normally, when someone is "committed by the state" (to quote the article) it means there was the proper adjudication, but that is not always so. For example, a peace officer can do an emergency commitment against a persons will and he would not have been adjudicated. That one gives the doctors three days, and if they manage to convince him to stay in for treatment, he could go without being adjudicated. A self-commitment does not trigger the federal law (at least as I understand it).

EDIT: And since it is Quanell X speaking as a representative of the killer's family, I, personally, have a lot of doubt as to anything that was reported. His slant seems to be that it was not the killer's fault, and even if he lied on the form the store should have known better anyway.

By the way, the killer had been walking in the road at night in Santa Fe, Texas,
which isn't far from Pasadena. This was quite some time before the murder was
committed.

He was off his medication and acting weird. When the SFPD officers apprehended him they beat
him to the extent that the suspect was awarded $125,000 for his troubles.
