Did Texas DPS ask for this misdemeanor info? Our timelines are near identical but they haven't requested any further background information.

She did mention that if they couldn't get that background that I would have to contact the city of Biloxi to get an abstract of the case. I have not received any request from DPS either. I called Biloxi and they still have the case in their database. It's $5.00 and a self addressed stamped envelope. Don't see why they can't just call them.

They are moving fast: My wife actually recieved her's Wednesday. 11 days after submitting the paperwork, 1 holiday and 2 weekend days in that 11 days.

She also told me that I was supposed to send in my own background from an a hiccup in 1993 from the police department in Mississippi where I had the incident. Funny, I don't remember seeing anything about any of this. She mentioned that they are not requesting anymore information from me for my application so where does this 180 days come into play? They received my full application on November 18 2016 and that I've been in background review since December 6 2016.

I'll have my Arizona permit before a Texas permit. I guess the great state of Texas isn't as free and conservative loving as I thought.

I'll have my Arizona permit before a Texas permit. I guess the great state of Texas isn't as free and conservative loving as I thought.
I got the same run around about a misdemeanor wqy back when, and because of it they basically put it on hold for as long as possible. The lady blamed the fbi background check, which is probably bull since it was a texas thing. Arizona packet is in the mail already headed my way.

Same here Chris. I know they will drag it out, then send me a letter requesting the info. I just left the post office after sending a self addressed stamped envelope to Biloxi to get the abstract of the case. I'll send that in and wait for my Arizona permit.

I'm sure if you listed something on the affidavit for prior history, they throw your application off to the side for 180 days and then send you a letter asking for more information. Something as stupid as a ticket 23 years ago and they hold it against you. I've served 22 years in the Navy, Secret clearance for 26 years, not even a speeding ticket in the last 22 years and all of a sudden you're a second class citizen.

The 180 days only come into play if DPS determines there is an issue with the application:
Government Code §411.176. REVIEW OF APPLICATION MATERIALS. wrote: (d) On receipt at the department's Austin headquarters of the application materials and the result of the investigation by the director's designee, the department shall conduct any further record check or investigation the department determines is necessary if a question exists with respect to the accuracy of the application materials or the eligibility of the applicant, except that the department shall complete the record check and investigation not later than the 180th day after the date the department receives the application materials from the applicant.
And, yep, the DPS agent was correct when she said you should have included disposition records from the 1993 arrest:
Government Code §411.174. APPLICATION. wrote: (b) An applicant must provide on the application a statement of the applicant's:
...(7) criminal history record information of the type maintained by the department under this chapter, including a list of offenses for which the applicant was arrested, charged, or under an information or indictment and the disposition of the offenses;
I'm sure the lack of corroborating records regarding the disposition of that Mississippi arrest is what fouled up your application. But I don't blame you: I blame your LTC instructor for not adequately explaining this part of the process.

I wish you'd found this Forum before you submitted your application. A little quick searching would have shown that the best course of action is to do the homework first and include copies of all relevant court records/dispositions with the original application. And unless DPS has your submitted evidence that an out-of-state arrest was dismissed or similarly resolved, it creates additional difficulty because misdemeanors aren't apples-to-apples among different states, and the offense has to be evaluated against what it would be in Texas at the time of the application, not the level of misdemeanor per the statues of the other state.

Best of luck to you. But it does look as if you might have some additional wait time. I very much doubt it will be six months if the offense turns out to be a non-issue, but some additional time, nonetheless.

The affidavit that one would use only ways to list the offense, date and disposition. I does not ask for anything more. Maybe they should include the request for official abstracts of each offense?

I knew about the 180 days if a determination cannot be made within the 60 days but to not tell you anything until after that time is rediculous.

At any rate, it's been sent to MS and I should have the abstract by the end of next week.

Got the abstract from Mississippi today and sent it in as a supporting document before they asked. Let's see if that's what they were waiting for.

My timeline:

01/19/2017- sent off for misdemeanor abstract from an arrest in 1993
01/27/2017- sent in the abstract from arrest

02/14/2017- Mailed


So, if you have ever been arrested and listed it on your affidavit, do yourself a favor and get the abstract of the case and send it in. Don't wait.
