Filing with a deferred adjudication and order of nondisclosure

Postby DWB » Fri Aug 18, 2017 7:19 pm

As the title says, I was placed on a non title 5 felony deferred adjudication 9 years ago and successfully completed the terms of my probation and was cut loose. I received an order of nondisclosure last year. After asking around and hearing several mixed answers about if I would be eligible or not I decided to go ahead and try to get my LTC. What documents pertaining to my case should I send in? I assume the final disposition and the order of nondisclosure judgment but is there anything else? I assume that if I am eligible there is still a chance that I will be initially denied and have to go through some kind of appeals process so I really want to get this right the first time.

The order of non-disclosure is the best thing to send. & this is what makes you eligible.

For those like me reading this post having never heard the phrase order of non-disclosure here's a little bit of information on what that means the term was new to me

I would say just final release and dismissal order, and order of ND.

If they want more, they will certainly let you know.

What charge is considered a non title 5 felony? I assume this was out of Texas.
2/26-Mailed paper app and packet.
5/20-Plastic in hand.
83 days mailbox to mailbox.

If you have the order of nondisclosure you should be good to go. Some friendly advice: If you wait until next month to apply, expect delays that have nothing to do with your background check, but the discount may be worth the wait.

I had already scheduled a LTC class for this Tuesday, haven't gone and gotten the fingerprints done, I will probably see about doing that on Monday. I haven't decided if I am going to wait until Sept to file everything, I know that the price goes down to $40 and that may cause a delay due to traffic. To answer an earlier question a Title 5 felony is a crime against another person which permanently keeps you from getting a LTC even if it was a deferred adjudication.
