It was a platter of fajitas for 2. Still too expensive if you ask me! I know this is kinda dumb, but it made me laugh...was hoping some others might get a chuckle out of it too!

On a serious note, at the Chuy's in Lubbock, one must pass through the bar room to get to restrooms. Plan accordingly.

Nothing says you can't go into the bar carrying as a CHL if a location is not a 51% venue. You can actually even sit at the bar and have a drink as long as you don't become intoxicated.

There is no such thing as 'no tolerance' for alcohol consumption as a CHL. TPC 46.035 states you cannot carry 'while intoxicated' and are carrying under the authority of Subchapter H, Chapter 411, Government Code (CHL code)

So you look at Subchapter H, Chapter 411, Government Code and you find:
§ 411.171 - Definitions
In this subchapter:

(6) "Intoxicated" has the meaning assigned by Section 49.01, Penal Code.

So looking at TPC 49.01, which is the definition for any intoxication offense in Texas that is not separately defined in the individual statute, and it says:
§ 49.01. DEFINITIONS. In this chapter:
..........
(2) "Intoxicated" means:
(A) not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or
(B) having an alcohol concentration of 0.08 or more.
So, bottom line, intoxication is left up to the discretion of the individual officer by means of a field sobriety test. Once you reach .08 BAC or greater you are legally intoxicated, no questions asked. Before that time the officer has to make the determination that you are or aren't intoxicated. You can actually be .00 BAC and still be intoxicated by means of illegal drugs, prescription or over the counter medications, health problems like diabetic issues or chemical imbalances, etc. The question comes into play as to whether the officer will take a harder stance on what he considers intoxicated if you are carrying or not carrying and where they will draw the line.

if it is discretionary, I'll just continue to avoid drinking at all when I go out then...lol

I just took "no legal limit" to mean that anything is too much...

Basically, this is correct since you could have one beer, be at .02 BAC, but due to the ingestion of other substances be 'bombed out of your gourd' as we used to say., and be intoxicated. And, any introduction of alcohol into your system will be affecting it, it just depends on how much it is. I am not a big drinker, and only do so on occasion even moderately. When I have, there have been times I only drank one beer and felt the effects because I was tired or had other physical things impacting my body, or maybe had taken some OTC cold medicine. Then, there are times when I may have drank 2-3 and really didn't 'feel' the effect of them even though I might have been higher up the BAC scale because my body was more rested or nothing else was influencing the feeling.

My recommendation is to always look at your physiology when you carry and know if you are feeling less than par for whatever reason. A simple cold and cold medicine may affect you to the point you are not as clear as you should be in your decision making and should leave the firearm locked up.
