Apparently, the judge asked him since both prosecution and defense recommended dishonorable discharge if he accepted that in lieu of jail time. If the deserter accepted that? Really? He was getting that no matter what! I don't understand why he was given any choice other than hanging or firing squad.

His defense attorney was very good. After the trial he denounced Trump and made statements that made his client sound like some kind of hero. Yes he will write a book and no doubt become a hero to the left.

Sometimes a judge and a good defense attorney can achieve a result like this. However, I suspect some jail would have been better for this man.

I am going to go out on a limb and predict, he will die by his own or another's hand within two years. He would be safer in jail.

I did not serve in the military (thanks to President Nixon's Vietnamization Program in 1972 and a draft number in the one-sixties), however, I think the Judge's sentence sends a terrible message to our military men and women who place their lives in harm's way every day. Bergdahl did not just desert from a national guard base in Iowa---he deserted his fellow soldiers in a combat environment. Maybe the Judge was an Obama/Hillary supporter who hated Trump---don't know.

You guys reckon he might have had to prove his worthiness to stay alive by pledging allegiance to Taliban and you know...perhaps pass their smell test that he’s one of them, by maybe firing on his fellow soldiers etc. you know..,like gang initiation and such...just thinking and such...

I’d be beheaded before I fired on my fellow soldiers or gave intelligence to the enemy.
Better to be at rest in a National Cemetery than walking the streets with the blood and deaths of brothers in arms on my hands.

Apparently Bowe wants his medals and $300,000 in back pay. I just assumed Obama had already given him all that stuff at the White House Rose Garden.

One of the brave soldiers who helped search for the AWOL Bowe Bergdahl and was wounded and paralyzed during the search has died from his injuries at 46 years of age.

RIP, my condolences to his brave family.

If you remember he was traded for the release of senior Talaban fighters by the former President, some of whom have reentered the fight.

how does a judge vacate a crime when he defendant plead guilty in the 1st case
and what does immigration have to do with military courts??

I understand how the judge could say the military judge might have been biased. He applied for a federal judge job and the ultimate decider (Trump at the time) on that had condemned Bergdahl. It is reasonable to assume that a normal person might have wanted to look better to the president by being harsh on Bergdahl.

But since he plead guilty, the judge did not do anything to change his conviction. I don't remember if there was a plea bargain agreement or not, but if the judge sentenced him harshly or more than the defense asked for, this might justify overturning the sentence instead of the conviction. And if it was in accordance with the plea bargain, how the hell was there an appeal?
