NYC: Ticketed for Littering? Gun License Denied

New York City has proposed rules that would give NYPD licensing officials the ability to deny a firearms license to folks who have an unpaid debt, have been ticketed for littering, or have poor driving records, among lots of other things.

Under those rules, most (if not all) of our founding fathers would have been denied firearm ownership.

Although New York is a "May Issue" state, I am still trying to wrap my brain around how one may have a state license but be required to have it "validated" to enter the counties around NYC. :roll:

I love the quote equating these restrictions to restrictions on the right to vote. Voting is much more powerful than whether you can legally carry a gun. Should we take away the voting rights of people who have failed to pay debts, etc?

Also telling that this disproportionately impacts the rights of poor people more than the affluent. It sounds like the goal might be to ensure that only the elites are armed.

Edit to add: I'd like to see a Federal law that simply states that anyone who has the right to vote automatically has the right to possess and carry firearms. A valid voter registration card would be sufficient evidence to establish an individuals right to keep and bear arms.

You know, I am not really upset about this. It fact, it may turn out to be a good thing.

Since NY is a "may issue" state, they can already deny your license for any reason or no reason. Eventually this new regulation will be challenged in court. Maybe the courts will rule that NY's gun permit laws are not applied uniformly and that they are unreasonable and vague.

There should be an exception for "littering tickets" if you attach a brass catcher. :lol:

The extra requirements are written right into the Penal Code, have been for almost a century.

The thing I find most ironic is that the article makes it seem as though NY licensing agents currently have less discretion, and nothing could be farther from the truth. The agents have always been able to deny a license based on any capricious or arbitrary reason they can dream up, or for no reason at all.

Back a long time ago I was "chairman" of a multi-club task force in Albany County NY. The impetus for our development was the very capricious denials and bench vetos of pistol permits, as well as the very political granting of them, something we had sought legislative relief from for some years. Having not been successful at getting legislation passed, it was always blocked by the downstate majority, it was suggested that we sue one or some of the officers who were the most blatant.

Long story short, we sued and established a time limit for grant or denial, as well as reason for denial being given in writing. Of course the time limits were constantly tested, and the reasons given were ridiculous, so we sued again, and again, and again, and ran out of money.

One of our suits was to stop licensing agents from "defacing" permits by writing "Hunting Only" or "Target Shooting Only" on the licenses. We lost and now it is part of the Penal Code.

Ironic that Fox doesn't know that NY State Pistol Permit licensing agents are gods unto themselves and get away with whatever they want.

Just playing devils advocate, but isnt this racism at its finest, how many minoritys in New York who are struggling financially will not be able to protect themselves, how many "priviledged whites" will get carry permmits. Liberalsism at its finest!
