If I must go somewhere that is 30.06 posted. I grab my handy hardwood cane, which I occasionally do need. With some Hipkido training and a lot of practice, at least I do not feel completely unarmed. It also helps you get through the airport, because I do not fly somewhere without my cane.

Not a cure, but definitely an option.
:iagree:
I too carry my hardwood cane, but but what if we take a ride for carrying a cane past a 30.06 sign???
Oh wait
30.06 applies to Handguns
and only to handguns carried under authority of a License to Carry

I have no license to carry my cane ... and it's not prohibited by law to carry without a license.... guess i won't worry about carrying that which is not illegal.
I seem to recall a Federal Law about Police araesting someone for something which i not illegal is a viloation of their cibil rights and the arrest cannot be made in good faith for that which is not illegal
:thumbs2:
You guys with your illegal clubs. Stick with the folded rifle.

You posted: "If they want to keep rifles out they would need a "No Firearms" sign."

Does a sign like that hold the force of law?

I know if I don't see a 30.06 sign, but a sign with a pistol circled & slashed I can ignore it.

How is a "No firearms" sign different?

Does it carry the same weight of a 30.06 sign?
I guess as much law as a sign that said "No Trespassing" or "No Entrance without a Shirt" as part of the trespass law. I believe they could ask you to leave and if not call the police. Does it carry the same weight? I guess that depends on the penalty. Class C misdemeanor for 30.06 but can be class A.

Are you sure?

I'm thinking such signs can't be enforced by law, but it's an interesting point.
The sign would have to have the 30.06 language to ban handguns AND language indicating that entry was forbidden to persons carrying firearms, for 30.05 to potentially apply (to long guns)
So wouldn't the "No Firearms" sign (not a handgun with a slash) cover the rifle part.

Not 100% sure but pretty sure that a "No Firearms" sign would mean no rifle firearms and you could be hit with a trespassing charge for carrying a rifle even if you had a LTC. That sign alone would not be enough to stop entrance of a LTC holder with a handgun as 30.06/30.07 would be needed. Also, as far as I know a SBR is still a rifle and not a handgun and would not fit under 30.06/30.07 which is exclusively for handguns carried by LTC holders. You don't need a permit to carry a rifle in Texas, concealed or open.

Abraham wrote:Thinking about the "rifle/30.06 loophole" I also wonder what would happen if you had to defend yourself against a criminal/terrorist say in a hospital.

If you have to shoot in self defense are you going to be prosecuted for using a firearm in a 30.06 location?
You used a rifle, right, I get it, but they posted 30.06 to keep firearms at bay. Now, I can see some overzealous anti-gun prosecutor going for the jugular.

Unlikely?

Hhhhmmmmm, maybe or not...
I really don't understand your logic here. 30.06 only applies to concealed handguns carried by a LTC holder. If they want to keep rifles out they would need a "No Firearms" sign. A "No Firearms" sign would cover rifles but unless they had a 30.06/30.07 would not cover handguns carried by a LTC holder. It is not a rifle loophole. They can easily post to keep rifles out as well. The fact that they don't post "No Firearms" means that you can carry a rifle in concealed or open and in the open case may be asked to leave.

Abraham wrote:TAM,

I posted: "Am I the only one to think if one is discovered by a LE officer (unlikely, but certainly not impossible) with a sub2K (or something similar) in a 30.06 posted location one might be taking "The Ride"?"

"Unlikely, but certainly not impossible" is of course what I hoped would also be noticed.

Murphy's law has a way of making events that seem impossible or close to it, possible...

That being said, I'm interested in knowing the opinions/possible outcome of what is likely to transpire "if" one is discovered by LE to be concealed carrying a Sub2k or similar rifle in a 30.06 posted location?

Nothing?

Have the Sub2K seized with a giant hassle getting it returned?

Be escorted out of the building with no further ramification.

Take the ride?

Or...?

Why do I ask?

Because I'm considering doing what you and some others are doing if I buy a Sub2k i.e., taking it with me in a computer bag/briefcase into 30.06 locations - but only if I know in advance what will happen (chances are remote, but again, not impossible) if I'm discovered with a firearm in a 30.06 posted location. (yes, a Sukb2000 is not a handgun, but is a firearm)

The ill informed or overzealous LE officer may not take my possession of a concealed firearm in a 30.06 location very kindly or act within the law. He doesn't know me. I could be a lone nut case out to do harm...

With a lawyer, much expense and time, I'll probably be exonerated, but is that something I want to face if things go south?

You think the chance of being discovered concealed carrying a rifle in a 30.06 location is very close to nil, but I have to think you aren't 100% certain absolutely nothing negative would happen to you if the long arm of the law were to discover Mr. Harmless Grandpa is packing heat...yes, it's a rifle, not a handgun, but it may also create major hassle if discovered.

Jusme,

Just as 30.06 locations are being posted with signs at inappropriate governmental locations while these governmental employees simultaneously thumb their nose at our AG, so too can there be overzealous LE officers taking inappropriate measures.

One of the major considerations I see with you and TAM is the thinking that says no LE officer would have reason to check your bag. OK, why would it be a concern if they did? Why bother considering if it's of no consequence?

Because the trouble you can't get in, you're concealed carrying a rifle, not a handgun, may just occur...
Since 30.06 only covers concealed handguns carried by LTC holders (as other laws cover non-holders) and no license is required to carry a rifle (that I know of) what law would be broken by carrying a concealed rifle? Now if the sign said no firearms than trespass laws would apply. Not to say that a LEO might not know the law. To me the question would be if there was a handgun with a line through it sign (gunbuster) would that apply to a concealed rifle?

Re: Sub2k Sub2000 folding concealed rifle

Amazon has the UTG

$25. It is a little big at 25" but has all kinds of velcro straps to hold everything down. I love my little Kel-Tec but have absolutely no plans to customize it. Play with the add-ons as you wish.

Tam, does it catch your beard?

I disagree. Both basically say no guns. If you want to interpret it to just mean handguns that is fine, I am sure your lawyer will gladly accept your payment to defend you when you take the ride. Bottom line is regardless of what is pictured both mean no firearms at all. This is just my .02
How do you know a handgun with a line through it means no trespassing with a rifle? The trespass laws are pretty specific and I haven't seen picture 1 as above to mean no rifles allowed. Picture 2 says no firearms allowed and I would consider that valid.

Made a trip to Lubbock (For the funeral) with the sub2k, between Nov 29th and Dec 8th too, in a 16.1" laptop bag along with spare mags, 2 Laptops. 1 tablet 3 phones and chargers, two Kimber Pepper sprayers, 2 folding knives, and 3 dog pepper sprays the Post office uses.. all in the 16" laptop case.

I just put the 32 round Glock mag in the Sub2000 and have a couple spare Glock 17 mags with +3 PierceGrip baseplates for extra 20 rounds each in the laptop case if that runs dry.

Obviously I have to leave my Glock 26 - 10 round handgun in the car I usually carry everywhere ... because ... signs ... it's the law you know, and I obey. I carry more ammo into the OSTENSIBLY "Gun-Free" areas which post 30.07+30.06 to keep ONLY licensees handguns out because "soft target" areas attract lunatic mass shooters/robbers and other criminals, so I carry extra ammo in those locations.

(Edited to correct typo, Mine is Gen 2 not Gen 3)
Most places that have 30.06 and 30.07 also have a no firearms or gunbuster sign. I don't believe you can carry past those as they have effectively forbidden all firearms.
The places I mentioned had no noticeable gunbuster signs, which have no force of law, and I didn't even see any applicable HEALTH AND SAFETY CODE sign, nor any 30.05 Penal Code signs, nor Sec. 46 Penal Code signs, but did have tobacco products prohibited and no smoking signs, I quit smoking on Thanksgiving 2011, so I'm good.
I believe gunbuster signs do have force of law where rifles are concerned.
Every gunbuster sign I see is a handgun with a line through it. Does not mean anything. Now if they say no firearms that is a different story as far as a rifle.
This means nothing

This keeps rifles out
