Re: Reason you decided to get CHL ?

I first got my CHL in '95, first year Texas offered them. My parents own some property about 45 minutes north of Austin and I used to travel up there to either work on the property a little or target practice. Even if I wasn't shooting I carried when on the property because it's pretty wild. Perfect...

Re: using deadly force

One of the issues is that burglary of an unoccupied motor vehicle is only a misdemeanor in Texas. So, unless you can prove that you were preventing the person breaking in from committing a felony, like stealing the vehicle, instead of just rummaging around for loose change, then you cannot use dead...

Re: How to disarm correctly

I carry fullsize 92fs in an IWB AlienGear holster. If I need to disarm, I go back to the car, scoot down in the seat a little and remove my gun making sure to keep everything below the sight line of the windows and slip it into the glovebox and lock the glovebox. Then do the reverse for re-arming. I...

Re: using deadly force

Penal code 9.31 and 9.32 are Texas' version of the Castle Doctrine... never a need for the king or queen to flee the castle before using force against an unlawful intruder. So if you are in your car when the attack happens than it is justified. If someone is burglarizing your car sitting on your dri...

Re: Present CHL if not carrying?

Could have been talking about before MPA was passed. (2006, was it?) Yes...this advice was given way before MPA. In any event, I just make a habit of handing over DL and CHL regardless of whether I'm carrying or not...It may be overkill and unnecessary if I'm not, but the law doesn't say that I can...

Re: Present CHL if not carrying?

My CHL instructor was a long time LEO now retired. I've taken several classes with him since 1995 (new license and renewal). Every class he always goes over when you are required to show your CHL. He said of course that it isn't required if you are not carrying, however, he recommended that you alwa...

Re: Is this 30.06 sign posted at Wholefoods compliant?

I guess the point is that you shouldn't knowingly enter somewhere where there is a 30.06 even if the sign isn't technically correct and you are discovered you will be unlikely to convince a jury that you weren't given notice. Based on the fact that there are 6 pages in this thread of people with dif...

Re: Is this 30.06 sign posted at Wholefoods compliant?

I asked a lawyer that specializes in CHL and 2nd amendment issues/cases and provided a picture of the sign. They said: Though that sign is sort of a mix of different restrictions, there is enough 30.06 language there to create a fact issue as to whether or not you had “effective notice” that CHL hol...

Re: Is this 30.06 sign posted at Wholefoods compliant?

If they have not posted the correct TABC Blue sign, you should report them to the TABC. The TABC law is not as specific as the 30.06: Sec. 11.041. WARNING SIGN REQUIRED. (a) Each holder of a permit who is not otherwise required to display a sign under Section 411.204, Government Code, shall display...

Re: Is this 30.06 sign posted at Wholefoods compliant?

If it has extra words than it is not exact. Pretty simple actually. Exact means exact not that it is okay to add more words, at least in most people's world. I'm guessing where this would lose ground in a court would be the word "includes": (B) a sign posted on the property that: (i) incl...

Re: Is this 30.06 sign posted at Wholefoods compliant?

I think by the letter of the law it meets the requirements for written notice in regards to the verbiage. But I think that the intent of " is displayed in a conspicuous manner clearly visible to the public " would suggest that the law requires it to be easily noticed by persons entering th...

Re: Is this 30.06 sign posted at Wholefoods compliant?

The signage is confusing in the least and I would say may not meet the requirements for "is displayed in a conspicuous manner clearly visible to the public." I've been to the Whole Foods in the Domain twice in the last couple of months carrying, including just yesterday. I pay attention to...
