Are you talking about this sign? This is the one I'm referring to. Probably 90% of the public stores in Texas have these posted somewhere, certainly every convenience store, gas station, etc.

That sign is required if a business sells alcohol. If 90% of the businesses you enter have this sign, then I'm guessing you tend to go places that sell alcohol. And yes, this is the sign that would become obsolete.

Absent a 30.08 sign, then carrying a gun (without a license) past a "gun buster" sign would be a class A misdemeanor in the same way that an overweight woman who gets in a car that has a "no fat chicks" bumper sticker also commits a class A misdemeanor today. Or a sales person who walks through a gate that has a "no solicitors" sign. These unlicensed gun carriers will be joining these other types of folks in "taking the ride", and being prosecuted.

At minimum, we need an unofficial mandate to federal LEO like what was done in the pot legalization states (don't arrest for pot possession).
I could be mistaken, but I believe that some LEO's carry while off duty. If those folks don't currently have LTC's, then they are likely violating the GFSZA on a regular basis, unless they have no schools in their neighborhood. That should be an indication of the likelihood of getting cited for a violation.

I have an LTC, but even if I didn't, I likely wouldn't be all that concerned about this until we get the first arrest for a violation (that is not tacked on to more serious charges). As far as I know, this has not happened yet.

All my guns are hot...not that I carry my rifles in walmart but...if I WERE to carry my AR in the walmart, the chamber WOULD be occupied. Not a fan of Kory Watkins. One reason being that he says things that should be left unsaid. What he said served no point in regards tp chambered or not chambered. The law does not, in any way, differentiate a loaded gun from an unloaded one...irrelevant to the discussion...

I won't carry an unloaded gun. I also don't typically carry an AK, but if I did, it would have a round in the chamber.

I also agree that it was counter-productive for him to mention that specific fact in his testimony.

I've been watching this all afternoon. It seems to be coming down to emotion and speculation (against) versus logic and facts (for).

You are correct if what I was sent is accurate, which seems to be supported by the Press Release. The language used in what I was sent is
"Pursuant to Section 30.08, Penal Code (trespass by person not licensed to carry handgun), a person who does not hold a license to carry a handgun may not enter this property with a handgun"
So if this passes, and a business with both a 30.06 and 30.07 sign doesn't put up the new 30.08 signs, only unlicensed people will be able to carry there.
If a new section 30.08 is included in a committee substitute, this is correct.

I wonder if we could get a requirement for a 30.08 sign for unlicensed concealed carry & a 30.09 sign for unlicensed open carry? :biggrinjester:
I like this idea. In English and Spanish with a requirement for 2 inch high block letters, and an unobstructed view of the entire sign(s) which must be posted between 3-6 feet from the ground and no more than 4 feet from each entrance to the premises.

Can we also add an amendment that "no guns", "no cops", "no fat chicks", etc., signs do not trigger potential trespass charges under 30.05? Maybe just leave in "no politicians" signs as instantly triggering criminal trespass punishable by no less than 15 years of hard labor.

This is exactly the case and it must be so. We cannot allow a law that would force property owners to either allow entry of everyone with a gun or prohibit entry by anyone with a gun. They must have the flexibility to allow licensed carry while prohibiting unlicensed carry.

Got it, and that makes perfect sense.

The anti-gun property owners can say what they want about our gun laws, but they can't say we aren't being accommodating, by basically allowing them to choose any combination of licensed / unlicensed, and open / concealed carry.

HB1911 seeks to bring handgun carry in line with long gun carry and restore Texas Citizens

right to carry a handgun without a license.

• HB1911 does not expand who can carry, only where they can carry. Millions of

unlicensed Texans carry handguns lawfully in their vehicle every day. We are only

expanding where they can carry.

• Must meet eligibility requirements in 411.172(a)(2)-(10), Government Code in HB1911

in order to carry unlicensed. This brings licensed and unlicensed carry on even footing

without having extra eligibility burdens on citizens to exercise their right to carry a

handgun just like they can carry a long gun today.

• 30.05 is amended to include exemption for lawful unlicensed carry of a handgun.

• 30.08 addition will empower businesses to choose who they let carry on their property.

• 30.06 and 30.07 are maintained for license holders.

• TABC “blue” signs are eliminated while maintaining the restriction of carrying into 51%

establishments.

• Unlicensed carriers will be able to carry everywhere licensed holders can except for

college campuses. Citizens will still need and license to carry (LTC) to conceal carry on

college campuses.

• Confirms State Preemption to unlicensed carry of handguns.

• Extends accidental carry at airport security to unlicensed carriers.

• Licensing is maintained as optional.

• HB1911 puts a protection in place for license holders to be able to petition a court to keep

their license. If he only reason someone has their license to carry suspended or denied is

that are charged only with a crime and not convicted, they can petition a judge. A judge

will look at the totality of the circumstances and render his decision based on that as to

whether a person can carry with a license until a ruling is made on their charges. This is

due process and has been lacking far to long for Texans.
I sure hope this doesn't mean that 30.06 / 30.07 signs will only restrict carry for LTC holders and not for those without an LTC. I assume I am reading this part incorrectly....
