Truth didn’t wanna go there but I am willing to bet this situation would have been handled differently if this were the scenario.

Wrong analogy. The correct analogy would be, MS13 member walks into residence, shoots and kills man. MS13 member claims he made a mistake by thinking it was his home and the dead man was an intruder. MS13 member says, "my bad".
Thats the point I am trying to make to cirrus but as humans we see things differently and he has a different point of view. How on earth can you walk into somebodys residence kill them and be like oh my bad ,sorry to kill you. It doesn't matter if his door was unlocked its his own APARTMENT. And it is pathetic to see people making excuses for the officer because she had a 10 hr shift as to say her behavior should be excusable because she was tired.She should be charged with MURDER plain and simple. Would she be charged with murder? High percentage that she wouldnt be.

Some mistakes are just unforgivable. Like some one mentioned earlier in the thread if it was an MS13 membrr the tone of this thread would be quite different. Imagine some one breaking Into your house and killing your wife or daughter or son. I doubt you would be saying oh it just was a mistake, don’t charge her with murder let’s just slap her with a manslaughter charge and maybe Even set her free. Just put your self in the victims shoes who was MURDERED in his OWN home.

He would have been probably sentenced to death already or life in prison. And I don't understand people. What does the dead mans toxicology report have to do with anything? He was shot DEAD in his OWN apartment. Just Wow ! It disgusting and unbelievable what some of these people think. To even fathom doing a toxicology report on a man shot in his own place?

This is getting comical. The innocent guy gets shot in his own apartment and they search his apartment lookingnfor contraband? To smear the name of a Dead man unbelievable. They really are trying to throw this under the rug per say. What does him having marijuana in his OWN apartment have to do with this lady shooting him? WOW !

Not an excuse, and jury still out on what exactly happened here, but fatigue is not a trivial factor either. The military and commercial air services came to grips with this a long time ago because when a pilot makes a fatigue-induced error that kills, it's immediate, spectacular, and takes a lot of people and $$$ with him. Hence flying hour restrictions are in place. The commercial trucking industry has sleep/drive restrictions. It appears to me the work shifts for doctors in training and in ERs are often pretty brutal, actually, and it's been accepted for a long time that it's part of being a doctor in those circumstances. Coincidentally perhaps, there seem to be a high rate of errors in hospitals. But the results of erroneous medicine happen to individual patients, one at a time, and are not always fatal,, and thus are handled individually. So short of cutting off the wrong leg they don't make a newspaper headline like crashing an airliner does.

Cops would seem to be in a similar situation as doctors -- long shifts, sometimes double shifts, probably most fatigue-induced errors are small and not very noticeable to the public at large. Applying duty hour restrictions to cops (and medical personnel) will drive up costs substantially, so I don't see anyone making a push for this any time soon.

Unless the door was wide open, the killer unlawfully and with force entered the victim's occupied habitation. Deadly force is presumed justified against the armed intruder.

However, if the victim had shot her, and he survived, does anybody really think he would be treated as gently by the so called justice system as she is being treated?
Of Course not. He would be sitting in a jail cell just as if it would have been me or you.

Apparently news is going round that the guy killed and the cop actually knew each other and had “dated” before. Don’t know how true that is but I’ve read and seen it several places.
