Just as the Texas Penal Code does not say a holster has to be on a belt, it does not say the holster has to be on the person. TPC 46.02.(1-1) says "on or about his or her person." What if the holster on the car seat was attached to a belt, would it be legal then? The law states no requirement for a belt to be present. But he handgun must be carried on the licensed person. So you could have your handgun in a belt holster tied around your neck with twine and you would be a-ok ...

I'd love to read/hear interview with the homeowner. Did he intentionally avoid torso shots to spare the intruder's life or did he miss his intended target in the heat of the situation?
