Federal Judge rules Suit against the City of Dallas lacked something. Dismissed. Not sure if this is a big deal or they will refine with this corrected.

Mentions ice cream again.

If you live in an apartment, don’t leave door unlatched or unlocked.

I have a popular car in a popular color. I don’t have to unlock the car door it does it magically for me when I pull the handle. A while back at a Whataburger parking lot, I scared the bejusus out me and a man in the driver’s seat who was surfing his phone, when I opened his car door. Neither one of us shot the other.

I have put a ribbon on the door handle.
Sounds like maybe Botham’s family hired an attorney who specializes in finding racism everywhere rather than actual law.

If he didn't have any arrests I don't think they would know.
I Bing'ed his name for Texas arrests, turns out "Joshua Brown" is a VERY popular name under which to be arrested. Too many for me to sort through.
I don't know the laws in Texas, but usually the attorney can impeach a witness if they are a felon.
Another reason for a higher court to declare the verdict void and to be retried?

Assassinated lawyer says.

Refuses to rule out police involvement!

False flag?
Brown had no criminal history, nothing stolen, "no suspects or motives"... beyond the obvious. Once again Dallas makes international news. No matter what anyone says, truthfully DPD's reputation is taking a dramatic turn for the worse here. Whoever murdered Brown deserves a lot more than 10 years.
Look for a guy named Jack Ruby.

This is a critical point. I think that, her admission that she intended to kill Jean instead of "stop the threat", her decision to send texts instead of rendering aid, and her testimony that she couldn't remember anything from the 8 hour deescalation training she had taken a few months before the incident and had changed nothing as a result of it all combined to drive the jury's verdict.
Why Guyger’s attorneys failed to prepare her to answer a critical question like that correctly is a mystery. Perhaps they did and she just blew it.
Since her texting/sexting has come out in the open, I wonder what she was concentrating on during that deescalation class if she remembered none of it?

I am not going to say I hope you die just like my brother did… I personally want the best for you. I don’t even want you to go to jail… because that’s exactly what Botham would want to. He then asked if it was OK for him to hug Guyger. So he did.

You just never know how it may come back at you one day. She probably thought nothing of posting the memes when she did it. Now it is being used against her to establish a state of mind. She was trying to delete all of them just after the shooting.

And remember...the internet is forever. Just because you delete something doesn't mean someone can't find it...like the Internet Wayback Machine, or wherever it was posted still has it on the server just not displayed.

Re: Officer Invades Apartment, Shoots Resident

I really thought she would be convicted of manslaughter. I agree with others who have said there is definitely some possibilities for this to be overturned on appeal and re-tried.

Sad story all around.

Only good news is "maybe" there won't be any rioting in the streets of Dallas tonight.

ELB wrote: Mon Sep 30, 2019 3:15 pm I haven't been able to follow the trial in detail, but I just went through some news stories, and … whatever happened to the neighbors who claimed that Guyger pounded on the door and called Botham Jean by name? That featured in more than one story (and I believe in this thread too?), yet the only testimony from neighbors I found were two women whose first inkling something was not right was hearing two loud sounds that took them a moment to identify as gunshots. At least one of them explicitly testified that she did not hear anyone shouting/pounding before the gun shots.

Also found this:
Jurors on Tuesday and Wednesday heard from Texas Ranger David Armstrong, who led the investigation into the shooting. Armstrong testified that his team interviewed 297 of the 349 residents of South Side Flats.

He said 46 of them told investigators they had walked to the wrong floor and put their key in someone else’s door, according to The Dallas Morning News.
I think she screwed up, and she should be accountable for that, but...manslaughter, not murder.

And none of them shot the other tenant.

Lynyrd wrote: Mon Sep 30, 2019 12:27 pm She is guilty of killing the man. I think this whole trial will hinge on what the judge, prosecutor, and defense attorney agreed to as to the options that will be presented to the jury to vote on. Having been a juror before, I remember one case where I wanted to do something that the judge did not offer to the jurors as an option.

Was her crime premeditated murder? No.
Did she make a mistake? Yes.
Should she be held accountable for killing an innocent man? Yes.
What statutes define the crime she committed? I don't know.

But here lies the rub. What will the jury be allowed to convict her of? What will be the punishment?
The judge ruled that the jury can consider manslaughter. She also said the jury can consider "castle doctrine" in their deliberations. Not sure how the castle doctrine applies if you are entering a residence other than your own and killing the lawful resident. :confused5

Whoa there cowboy. Why?

The police were not called to that apartment. She was not investigating a crime. She was not in pursuit of anyone. I'm curious about your assertion that she technically had a right to be in someone elses home.
It wasn't a home, it was an apartment. There is a significant difference between the occupant and the owner. The owner of the property probably didn't have a problem with a LEO resident keeping an eye on things to make sure they are safe. In Texas, tenants do not have an absolute 4th amendment privacy right because it's not their home. The apartment owner can enter the apartment or have a PROXY enter the apartment such as a repairman or a security guard.
You must be tired after making such a huge leap. That you believe that an off duty police officer has a right to be in someone else's apartment is Grand Canyon kind of leaping. Not even Evel Kneivel was able to do that.

Re: Officer Invades Apartment, Shoots Resident

The accused profession should not be considered by anyone who forms an opinion as to whether or not the law was broken.
If Guyger was a mere LTC holder who did the killing of an innocent man in his own home, would the Ranger make the same conclusion?
