Bankruptcy isn't my area of practice, but filing bankruptcy doesn't mean they avoid the debt. Depending upon how serious the defendant is about pursuing the attorney fee award, life in bankruptcy court is not a pleasant one. Bankruptcy fraud is not a trivial matter either.
