Ok then I must be missing or misunderstanding the statute.
It says in part
Sub section (e) states(c) Except as provided by Subsection (e), an offense under this section is a Class C misdemeanor.

I see no other text that modifies the offense to a class B..(e) An offense under this section committed by a person younger than 21 years of age is punishable in the same manner as if the minor committed an offense to which Section 106.071, Alcoholic Beverage Code, applies
Where is the part that supports "As long as he has not had two previous convictions for PI.it would then be a class B" please.
