Re: Two arrested at Austin Capitol during open carry rally

The necessary threshold for a Section 42.01 (a)(8) Disorderly Conduct offense would be the use of threatening language directed towards another person in conjunction with THE DISPLAY of a deadly weapon in public IN A MANNER CALCULATED TO CAUSE ALARM. Holstered NON "firearms" = "NON "handguns" , and ...

Re: Two arrested at Austin Capitol during open carry rally

Actually the Supreme Court has not held license/permit issuance requirements imposed on activities involving the exercise of civil rights to constitute a violation of the Constitution. The SCOTUS considered licensing programs designed to maintain peace and order -such as the Texas CHL law- to fall u...

Re: Two arrested at Austin Capitol during open carry rally

Reality check. Those folks at the Capitol were engaged in a peaceful, and lawful assembly, and were violating NO TEXAS LAW. The Travis County D.A.'s office did not like the message they were communicating plain & simple. These people that were arrested Sunday were defending YOUR Texas Constitution.

Re: Two arrested at Austin Capitol during open carry rally

1845 Texas Constitutional convention delegate one Mr. Oglethree offered the proposition that.............."No person in a civilized democratic society should need to go armed against his fellow citizens." So true. Only one little caveat......."civilized"... yeah ...right....... Ain't there yet are w...

Re: Two arrested at Austin Capitol during open carry rally

Perhaps what can be easily overlooked amid this grass-roots activism availing itself of THE LAW regarding pre-1899 BP revolvers and long guns is that this is not happening within a vacuum. Texas law 46.02(a) classifying ANY manner of handgun carry as a criminal offense , subject only to statutory sp...

Re: Two arrested at Austin Capitol during open carry rally

The "open carry" of replica & pre 1899 cap & ball revolvers IS NOT ILLEGAL IN TEXAS... but......apparently.. ...... in Travis County the RIGHT to peacefully assemble in a public place ( the Texas Capitol ), and exercise the RIGHT of lawful and peaceful expression of THAT MESSAGE .....is not "LIKED" ...

Re: Gun Free Zone D.C.

The media, and the corrupt anti-2A politicians will trot down their usual path following yet another horrible mass shooting incident. Once again - we have a person known to have been " undergoing treatment for severe mental illness " . Ft Worth police department gave this nut a pass for firing a rou...

Re: Will you change How you carry after Sept 1.

" Displays.......in the plain view of another person" constitutes open carry. Therefore open carry is still illegal in Texas as of tomorrow morning. "Intentionally fails to conceal" was simply intended to proscribe open carry in the first place. To that extent " intentionally fails to conceal " has ...

Re: Will you change How you carry after Sept 1.

NO. I don't envision making any changes to my Texas IWB carry manner. My personal take is that - The new wording of 46.035(a) defines the offense committed on or after 09/01/2013. Therefore our long-enduring " friend" of the past 17 years ( "...intentionally fails to conceal..." ) no longer needs to...

Re: Open Carry Walks

I heard tell of another " pastor " who was also quite the respected community organizer and social reformer of his day who was reported to have urged the members of his community to carry a sword whenever they were going into harms way. It is said that he even went so far as to suggest that if they ...

Re: Video from Patrick Requesting Campus Carry

Perry would like to be President - everything else is secondary to that " like". He knows he doesn't have a chance in 2016 .....but he can serve as a schill for the establishment GOP to lessen the chances of someone " dangerous" like Rand Paul, or Ted Cruz getting the nomination. I'm ready to jump s...

Since criminal defense attorneys, and civil litigation attorneys are also " officers of the court" they should be included. They also are at risk of becoming the object of criminal confrontation...............as is " EVERY CITIZEN " IN TEXAS ! HEllO.............!!!!!!!!!
