Re: Knife Preemption Law changes

It is actually my intention to smack Potter County over the head with it. They have all their buildings posted .06 and .07. I suggest talking to an attorney about the best way to go about it. I'm not an attorney, but I suspect that the easiest route would be to try to get something in writing (eith...

Re: Knife Preemption Law changes

While everyone here likely knows that knife preemption passed last session. Very few have read the actual changes. In the municipality section knife wasn't added to part 6 where most the relevant exceptions come into play. In the county section simply adds knife to the preemption. Now. A knife that...

Re: Is the statesman article about carry in state mental hospitals accurate?

I wasn't expecting this to go this deep when I posted the question - lots of interesting stuff, it's good reading watching you two talk :) I should probably note that I originally held the same position as Keith B. About seven years ago I wrote a local TV news station, complaining that they'd incor...

Re: Is the statesman article about carry in state mental hospitals accurate?

Here is an old post in which Charles notes the existence of case law stating that a clause using the wording "does not apply" is a defense to prosecution, not an exception: http://www.texaschlforum.com/viewtopic.php?f=7&t=15541#p176511 OK, what I vaguely remembered from Charles post was the part in...

Re: Is the statesman article about carry in state mental hospitals accurate?

As I previously pointed out, the fact that "does not apply" only creates a defense to prosecution means that concealed carry is still statutorily "prohibited" in those locations. Can you point to a definition or case law that shows this is the case? Just wanting clarification. I don't remember whic...

Re: Is the statesman article about carry in state mental hospitals accurate?

Actually, PC Sec. 46.035(i) is technically a defense to prosecution, not an exception; therefore, the statutory prohibition against concealed carry in a hospital, amusement park, church, or governmental meeting remains; however, you have a defense to prosecution if the location is not posted. Actua...

Re: Is the statesman article about carry in state mental hospitals accurate?

Didn't quote your post from above, but the exemption for a government building being able to post a 30.06/30.07 will apply to a government owned hospital building. Since section (i) went into place it actually removes the prohibition from hospitals, amusement parks and churches unless they post a 3...

Re: Is the statesman article about carry in state mental hospitals accurate?

[ I looked into it, and Hospitals are prohibited in 46.035, not 46.03, so why add 30.06 (e) specifically referencing both 46.035 and 46.03 unless it was to allow them to be posted? If you are correct, a city council meeting could not be posted any more than a government owned hospital. When SB 273 ...

Re: Is this a campus carry conflict of statutes?

Am I crazy or does 411.2031b authorize carrying a concealed handgun on campuses ( which includes buildings, streets, property, parking) today, right now, unless prohibited with. 30.06 notification?! 46.03a-2 says the same thing but doesn't kick in til August 1. One is government code and the other ...

Re: Is the statesman article about carry in state mental hospitals accurate?

Tom Benning of The Dallas Morning News updated his article on this issue, to better explain the law: http://trailblazersblog.dallasnews.com/2016/01/texas-state-psychiatric-hospitals-including-one-in-terrell-now-allow-guns.html/ Benning is one of the few reporters you can typically count on to get th...
