An Oklahoma man ends up killing his own 13 year old son who he thought was someone trying to steal the older son's truck. :mad5

Rutherford's attorney, Winston Connor II says, "Tony and his family are very sorry by the loss of their child and time will reveal the circumstances surrounding this unfortunate incident which does not constitute a crime"
Regardless of the mistaken identity, I am not sure you could get away with chasing and firing shots at someone driving away with your vehicle. Probably depends a lot on the prosecutor, your lawyer, and the jury you may get.

Beyond that, just tragic circumstances and decision making.

from my understanding you can. If someone is stealing your property you can try to recover it by any means necessary. with that in mind tho dont go shootign someone who's stealing your $500 lawn mower. lawyer fees will probably be upward of $10k. id rather just cut my losses on the lawn mower.

Oklahoma law on the use of deadly force will govern this case.
Lots of questions too---what is the 13 year-old doing out driving his brother's pickup at night? A joy ride? Sounds like it. A terrible tragedy.

I just reinforced the “know what your shooting at” and “what’s behind your target” lesson. I hope at least that is learned by others in this HORRIFIC incident
