Pretty clear cut case of murder.As the woman was leaving the property, the man got into his Ford Focus and ran her over several times.
To the LTC holder, Thank you Sir for defending the community!

Suspect in custody now! Two people with CHLs opened fire and flattened one of the tires. They are being treated as witnesses.

Granted, the situation was dire and rescue/support/justice was needed but, two CHL holders opening fire on the fleeing vehicle? There must be more to this story, eh?
Re: CHL holder attempts to stop fatal hit & run.
"Sandoval said he saw the man calmly getting out of his vehicle to see the woman's body stuck under the car before the man drove off." So the car was being driven away as the two LTH holders started shooting at him ... Doesn't seem like a good choice on their part...

I don't think I would have fired at a car that was leaving the scene. Write down plate number, call the cops.Killadocg23 wrote:They better get ready for a big lawsuit coming their waySteve W wrote:"Sandoval said he saw the man calmly getting out of his vehicle to see the woman's body stuck under the car before the man drove off." And this will be reported by the MSM as a school shooting, since it happened in a school parking lot. Even though it happened on a saturday, when the school was closed.

I grant that it was not a good choice, but who is going to sue them? The murder victim’s family? Not likely. The suspect? He wasn’t shot. What I can see happening is authorities deciding to charge the LTC with something like “reckless endangerment” or some such.......but I don’t think that’s likely either. What has happened here is that a LTC, acting in good faith, made a very boneheaded move; and he has likely ducked a bullet (so to speak) for his bad judgement.Killadocg23 wrote:They better get ready for a big lawsuit coming their waySteve W wrote:"Sandoval said he saw the man calmly getting out of his vehicle to see the woman's body stuck under the car before the man drove off." Re: CHL holder attempts to stop fatal hit & run.
Nope - I'd have shot at him, too! Deadly force is perfectly legal to prevent the fleeing of one who has just used unlawful deadly force, so if I had a clear line of fire, you'd better believe I would empty every round I had to get him to stop. I'm not going to wait for the cops to come collect him in minutes or hours, during which time he could murder again...Allons wrote:I don't think I would have fired at a car that was leaving the scene. Please cite the relevant law that justifies this.imkopaka wrote:Nope - I'd have shot at him, too! Deadly force is perfectly legal to prevent the fleeing of one who has just used unlawful deadly force,

LTC's are not LEO's.
Highly dependent upon circumstances before we step in slinging bullets.
Shooting at a fleeing car?
Do you know for certain where your misses are going to end?
Bad idea.

(1) the actor reasonably believes the conduct is immediately necessary to avoid imminent harm;
(2) the desirability and urgency of avoiding the harm clearly outweigh, according to ordinary standards of reasonableness, the harm sought to be prevented by the law proscribing the conduct; and
(3) a legislative purpose to exclude the justification claimed for the conduct does not otherwise plainly appear.

Of course in places like Austin the local DA may interpret the law differently
