Hearing Protection Act and TPC 46.05(a)(1)(D)

Post by mr1337 »

Anyone know if there's a push to repeal 46.05(a)(1)(D) in preparation for the certainly imminent vote on the Hearing Protection Act next year?

Code: Select all

(a) A person commits an offense if the person intentionally or knowingly possesses, manufactures, transports, repairs, or sells:
	(1) any of the following items, unless the item is registered in the National Firearms Registration and Transfer Record maintained by the Bureau of Alcohol, Tobacco, Firearms and Explosives or classified as a curio or relic by the United States Department of Justice:
		(A)  an explosive weapon;
		(B)  a machine gun;
		(C)  a short-barrel firearm; or
		(D)  a firearm silencer;
	(2)  knuckles;
	(3)  armor-piercing ammunition;
	(4)  a chemical dispensing device;
	(5)  a zip gun; or
	(6)  a tire deflation device.
Ideally, we would repeal all of 46.05, but I understand that might not be viable. If the HPA does away with registering suppressors with the ATF, how would we keep in compliance of 46.05? My only thought would be to proactively repeal it in preparation for what could happen in federal congress next year.

There's another thread around here someplace on a bill to remove silencers from regulation by Texas code.

Here's the list of all gun-related bills introduced so far:

Good catch, thanks. Should have known someone would have already brought it up.
