Winstar parking lot car meet?

#1

Post by Natesac »

Traveling to OK soon for a car meet. The meet will take place in a parking lot of the Winstar casino. I have been searching for an answer and have found very conflicting information. Are we good to carry in the parking lot? We will have zero need to enter any of the Winstar buildings.

I believe Winstar is located on the Chickasaw reservation. If that's true all state laws and most federal laws are out the window, including the ability to concealed carry.

I have never seen anything posted about not carrying on their property, just the casino. I stayed at the BW next door a couple of times and always carried while I was there. Also, I've not noticed a sign that says it is Federally owned land but Pawpaw could be absolutely right.

Edit: After Googling it, I believe Pawpaw is right about it being Federal land, so likely no conceal carry.

Since it's owned by the Chickasaw Nation, would US Federal regulations be applicable? I thought Indian reservations were considered sovereign, at least to some extent. If so, the Chickasaw Nation could have their own regulations for concealed carry, even in the casino.

13. Possession of firearms on Nation’s property is prohibited. The Park has zero tolerance for the brandishing, possession and/or discharging of any and all firearms, weapons or fireworks. Discharge of weapons or fireworks will result in the contacting of local authorities and immediate eviction from the Park.
This is from the RV page, but I believe it is applicable.

The car meet is actually happening in the parking lot of the Inn at Winstar but it's still owned by Chickasaw Nation divination of commerce so CC is technically not allowed and you are not supposed to even have them in your vehicle on Chickasaw property. I've worked for the Chickasaw people for 8 years and that's about the only issue I disagree with them on. One positive thing is the Lighthorse police could care less if you CC in the parking lot and are a upstanding member of society, I've had my personal vehicle searched by Lighthorse during a random employee parking lot sweep and when I told the female officer my Kimber was in the glove box she acted as if she could care less. Just remember concealed means concealed.

I have been researching this very issue. I'm an oklahoma instructor and so far had no success with the Chickasaw nation obtaining any definitive documented information. On the other hand, the Choctaw nation makes their criminal code readily available on their website. The choctaw criminal code closely matches state code. You are just fine in the parking lot, just don't go into the buildings. By the way, all signs count up here, but it is civil fine.

YMMV

Ok folks I am an oklahoma instructor and these questions come up all the time. After extensive research, I have the right answer for Choctaw Nation owned property, including all their casinos. For the Choctaw Casinos, the right answer can be found at the following link in chapter 53 of the Choctaw Nation criminal code. The laws pretty much mirror Oklahoma state law. All posted buildings are off limits for carry. (remember in oklahoma any and all signs count) Parking lots are excluded and may not be posted. There is even civil remedies for any government or business entity that tries.

Back to the original question. The Chickasaw Nation has been less than cooperative on providing any written answers. Email correspondance and phone calls have only yielded their zero tolerance policy. I suspect that getting caught on their property with a concealed handgun anywhere could in a wide range of actions depending on who you deal with and their attitude. Remember they are a sovereign nation and without their own written code, they could fall back on federal law, state law, or just make stuff up. Any court actions would begin in their court system with the appeal process thru the federal court system.

My best advice when going to winstar is leave your gun at home. If not you are taking a risk with a wide range of potential outcomes. If you enjoy the casino amenities, take your business to Choctaw.

As a footnote for your Texas MPA friends, there is NO MPA in Oklahoma. Get caught with a loaded handgun in you vehicle without a valid permit, we honor all state issued permits, you will be cited, fined, and your gun confiscated never to return.

This a timely thread resurrection. Wife and I are heading up to Winstar this weekend and really dreading the drive unarmed. I think we've decided on putting em in the trunk prior to arrival and leaving them there until we get off the property.

I'm assuming they don't check customer trunks, right?

Unless you are doing something wrong, there should not be any issue.

Indian nations cannot prosecute non-tribe members criminally under Tribal Law. They must have the State prosecute under state law, or the Feds under federal law. There are actually very few federal laws regarding CARRYING firearms, and none that I know of in regards to Indian Nations.

That said, the Indian nations have been known to seize firearms from non-Indians and/or use State trespass law to prosecute. Also, good luck getting your gun back... It would be a civil matter and Tribal law would likely control.

But if one were to conceal & carry on Indian land in Oklahoma where no signs were present, I'm hard pressed to see what you'd get prosecuted for. Even signs in OK aren't as clear as 30.06 in Texas. Most OK forums I've visited suggest you must be asked to leave before trespass may be invoked.

We were at Winstar last weekend and there was not a sign to be seen regarding concealed carry, at least that I saw in the parking lots or the casino itself.

That being said, neither of us carried on tribal land. The guns (not our normal EDCs, but the backup guns just in case) were stowed in the trunk long before we got there. Had a good time.
