Good news, bad news.....but I am alive. [PART 2]

Post by HEMIzygote »

First off, I am back in Texas. To answer the question on everyone's mind of where it occured - here goes:

Worcester, Massachusetts.

I guess the easiest way to continue is to start where I left off.

I went into the police station and received treatment I wasn't expecting. I show up and they take me into custody - I wasn't expecting that to happen. Why? Because Texas and Massachusetts are not reciprocating (which I knew) so therefore my concealed handgun was illegal. But I had called ahead and asked about the Mass. Castle Doctrine, which they do have, and I was clear to carry concealed at work under Mass law. I just never asked permission from my employer (I figured I knew the answer and best leave it off the record). I questioned why I was in custody for a legal carry at work, and they kept answering my Texas CHL isn't valid. Why this wasn't an issue when I presented it at the scene - I don't know. The charges were dropped this morning after it was confirmed my concealed carry was legal under the CD.

So, as of now - I have no charges against me. I was in custody from my arrival Wednesday to 940am this morning.

This is where it gets confusing - the company who owns the pharmacy 'chain' I was working for, doesn't own the pharmacy at all. They rent everything, including the drug stock which is all ordered automatically by what we fill. For those that don't get that - I'm with ya....I have no idea how that works or makes money for that matter. Moving on......

Now guess who owns the pharmacy - the hospital. The hospital has the option to file charges against me for possession of a firearm, but the way it looks - that won't happen since a innocent victim was executed when it could have been all of us. They have to keep the image of the hospital clean and mainly out of the media.

So, as for most the legal part I know so far.....I am back in Texas, legally - I have no charges against me - and yes, I still have my pistol (with an carry magazine now).

After I was released, I was asked if I had any question. I had millions of them, but the only one I could think of was - Who was the sweet old lady?

They told me what they could, but everything was clear after hearing it.

Her and her late husband had no children of their own. Before his death, they adopted kids who had no parents and moved from foster home to foster home cause of their behavior. Now I know why she was arguing with the bg that shot her - she dealt with problem children and invited them in her home - why should work be any different.

I just got sick to my stomach after hearing that - everything just clicked as to why it happened the way it did. I went and sat in the chair and the arresting officer sat down next to me. I guess he figured I put something together. I explained it to him - and what he said helped. If she hadn't been shot, the situation might have gone another way. No one would have been shot and it would have just been a robbery, or we all could have been murdered - no way to know.

I guess I just get to live with what happened and know she is reunited with her husband.

I bought a newspaper for my flight home and there was nothing in there about a shooting. I'm curious as to when this will make the paper. I missed the Wednesday evening news due to my overnight stay.

I have received PMs and emails and will reply to them, but most the questions were answered with the first few sentences.

Got questions? Ask away....but please don't turn this thread into a argument.

Welcome back!

I told my wife about your thread the other day and really wanted her to read everything so she could understand even further why I carry, and why I want her to as well. It certainly sounds like things could have been much worse for you, so be thankful that you are back home and able to resume your life.

WBZ-TV, is a sister station in Boston, I'll give them a call tonight...
again, glad to admit my doubts were wrong if this checks out at all...
as arrest records are a part of public record, i can have that checked on immediately and have results some time tonight...

glad to hear everything is working out Hemi... sorry for questioning your story, but sometimes things need to be checked.

from earlier posts, i believe you're 21/22yrs old... just need to check b/c i can use this to help verify the correct report.

Hemi,

I spoke to 2 police officers at that police department. There have been no shootings, pharmacy robberies, or fatalities according to them. Still trying to give you the benefit of the doubt. But.... :?: :?:

MA doesn't have a 'Castle Doctrine' law like we do here in TX. Under MA law, you don't have to retreat when in your home or place of business, but that's about it.

MA has a 1 year mandatory minimum sentence for possession of a firearm without a MA FID card (if a resident) or a MA LTC (if a non-resident). This even applies to possession in your own home or place of business.

They do not recognize out of state CHL's, and your out of state CHL does not allow you to carry or possess firearms in your home or place of business in MA. The only exception for non-residents is if you are carrying unloaded and locked up firearms en route to or from a match or practice session.

Now the police may have elected not to charge you based on a necessity doctrine. (Not sure if MA law recognizes this but it probably does in some form or other.)

With 4 bodies on the ground, I'm pretty sure the Worcester County DA will be presenting this to a grand jury.

I have a lot of friends up there. I sent out some emails tonight to see what they have heard about this incident.

Original story was told. Several people were unable to substantiate said story, and felt it must be a fabrication. Some name-calling and insinuation followed. Thread was deleted.
