Residency...and purchase

Post by pt145ss »

Ok…the girl who lives next door wants to buy a pistol for home protection. When she went to the store (I do not know which store she went to) there was a sign saying that one must be a resident for six months in order to purchase a firearm. Is this true? I know I should know this, however, it has never been an issue for me so I guess never thought to look it up or anything. If this is true, what are her options? I would assume private sale is always an option.

That store is allowed to make the decision not to sell to anyone who has not been a resident for more than 6 months, but there is no federal or state law with to that regards. You can buy rifles across state lines all the time. And I believe the requirement is just that you are a resident to purchase a hand gun. That can mean as little as a few days in order to have a utility bill with proof of residency or whenever you get your ID changed and receive the plastic.

So absolutely wrong for rifles. (I am sure of this one)
Probably wrong for handguns. (Pretty sure on this one but not positive)

I know of no such requirement. The only residency limitation is on non-resident aliens, and that's 90 days.

She could just go to a store that wants to do business instead of play lawyer.

That requirement applies to *resident* aliens as well (aka. green card holders). Resident aliens are
required to show proof of 90 days of residency for handgun purchases.

Maybe that is her problem...she just moved from California...don't you need a green card when you enter the united states...LOL.
