I would not blame Cabelas for this I would bet it was the person you were talking to. I have more then once had someone at the gun counter tell me something I knew was wrong and just asked for another sales person and It was cleared up. Keep us posted what you find out.

I agree. If the US gun laws are not complicated and illogical enough, adding "non-citzen" to the equation makes it even more confusing; so much so that years ago ATF issued a memo to explain when/where/how non-citizens could purchase firearms because many dealers were needlessly turning away sales to aliens that were perfectly legal.I would not blame Cabelas for this I would bet it was the person you were talking to.

I have spoken with Daniel in the Buda Retail Gun Department and from the guidelines that he read to me in this situation from the ATF laws, we do have to have statements within 10 days then dating back to 90 days for a proof of residency. If you have any further question please contact him at the Gun Department. He will be happy to help.

We are sorry about what occurred on the attempted purchase of the shotgun. We do not have information on the Federal and State Laws. You will need to contact the Buda store. Please go to customer service and ask for the manager. They will be able to help out. We will also forward your comments on to them at the store.

I contacted an FFL that I use and he thinks it is probably an rear covering corporate policy as it is not ATF's. So it looks like I won't be buying from cabelas for 20 plus days a month!

Straight off of the 4473 help for item 20c:
Sale of Firearms to Legal Aliens: A buyer who is not a citizen of the United
States must provide additional documentation (beyond a valid government-issued
photo identification that contains the buyer’s name, residence address, and date
of birth) to establish that he or she has resided in a State continuously for at least
90 days immediately prior to the date of the sale. (See Question 13.) Examples
of appropriate documents to establish State residency are utility bills from each of
the last 3 months immediately prior to the sale or a lease agreement that
demonstrates 90 days of residency immediately prior to the sale. A licensee may
attach a copy of the documentation to ATF Form 4473, rather than record the type
of documentation in question 20.c. Acceptable documentation to prove 90-day
continuous residency must be original documentation (e.g., utility bills, current
bank statements, rent receipts, mortgage payments, lease agreements, personal
property tax bills, documents issued by Federal, State, or local government
agencies, first-class mail issued by government agency, insurance policies, or bill
with current address or major credit card bill).

Not that I agree with Cabela's, but the instructions on the 4473 do say, "immediately prior to the sale". What does "immediately" mean? Is that the same day, same week, or same month? Cabela's appears to have taken a corporate position on the definition of "immediately". As long as they consistently apply and publicize their policy I don't see anything extremely wrong with it... aside from being a huge pain in the rear!
