Guys,
I'm sure this has been discussed sometime here, but I missed it. Whadaya' guys think about disarming in a university parking garage? I think it's kosher, but do LEO and prosecutors consider the garage a university building?

(3) "Premises" means a building or a portion of a building. The term does not include any public or private driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area.

You're good to go. Hopefully campus carry passes and it will be a non issue.

Re: School Parking Garage
Is the question actually about disarming (removing the firearm from your person and concealing it in your car) when you park in the garage, or with regards to having the weapon in your car (concealed, of course) when you park your car in the garage.
To answer both points, if you can remove from your body and secure in your vehicle without being seen, then the decision to do so is up to you. I believe you can have the weapon in your car in the garage, or parking lot on campus, unless prohibited by campus rules that may result in school disciplinary action. Not illegal (I believe) by law or statute.
I conceal/secure my weapon in my car prior to leaving for school, that way I don't risk a pedestrian or security camera somewhere observing me disarming and campus security swarming all over me, followed by local PD, SWAT, and whoever else gets called. I say this because there are some very observant kids on campus. I was between classes once and went to my Harley to swap out books and someone called the campus PD saying there was a suspicious man going through the bags on someone's bike. When they arrived (with backup) I was sitting on a bench nearby studying. They were polite and professional, asked for my ID. I may look a little old to be a typical student (must be the gray in the beard....)
In other words, what you do as an innocent act may seem threatening to others and be reported as such. Use the best care and judgment you can.
Don't take things for granted, and remember that the perception of others is the reality for them. All they'll see is a man with a gun. They don't know you are just securing it.

Thank you; especially for providing the wording.seamusTX wrote:- JimPC 46.035(f) In this section:

Re: School Parking Garage
P.S.: Concealed means concealed. If you pull out your roscoe and flash it, expect to be warming a steel bench in the police station for a while.
There are holster systems that allow you to remove the entire holster and handgun in one smooth motion. With the use of a towel or bandana, you can then secure the weapon inside the vehicle.
As a general rule, I never get out and put something in the trunk and then leave the vehicle. That tells an observant thief where to look first. Also, in most cars, if you get into the trunk, you can get into the passenger compartment.

Re: School Parking Garage
They are, of course, correct. However, if the school finds out and it is against their "policy" to have weapons on campus then you could still be fired or expelled. Be safe and keep it concealed.
