handgun on their person when in a motor vehicle, but are subject to prosecution if the handgun is
visible in the motor vehicle, but not on their person. H.B. 1407 seeks to close this loophole by
allowing a license holder to have a handgun visible in their vehicle, regardless of whether it is on
their person, as long as the handgun is in a holster.
"Shoulder or Belt" was dropped when in a car.
Since HB 1927 removed TPC 46.035 and HB 1407 changes TPC 46.035, enacting HB 1407 would cause a conflict. HB 1927 removed all instances of "shoulder and belt" from the penal code so we have the same net effect when HB 1927 passes.
