Just heard the news CBS7, Midland man at HEB was arrested for failure to conceal. Aparently he had a shoulder holster and "bikers" vest. Gun was visible and some store patrons called police. He had a valid CHL. Not much more info. I'll see if there is more detail in the newspaper tomorrow.

Doesn't sound like he tried very hard to conceal.

Hope he's got a lot of money, cuz he's gonna need a good lawyer to beat that rap. Looks like he broke rule #1 of CC too: It ain't concealed if people can see it.

You guys should have heard the news cast. The lady made a big deal. "FEEEAAAREED FOR THEIR LIVES" with eye wide open and mock fear expresion on her face. She then went on to say "a man with A GUN (eyes wide open again. Along with a expression of disgust at this actions.) walked into HEB". I yelled at the stupid lady and the TV the news cast ticked me off so bad. The wife walked into the living room and said "are you OK?" :)
Basically what is printed in the article is what was televised.

I'm right there with ya, but as was mentioned above...concealed means concealed. Sucks that there are Texas CHL holders out there this careless. He deserves to face some stiff consequences.

I disagree.

Yes he broke the law but he does not deserve to face stiff consequences for exercising his second amendment rights. He simply viloated the terms of his government issued second amendment permission card.

This is as bad an infringement as we have been fighting recently with the potential ban.

This is a prime example of legislation making criminals out of innocent citizens exercising their constitutional rights.

IF WE AS A PRO SECOND AMENDMENT COMMUNITY DO ANYTHING WE NEED TO FULLY SUPPORT THIS INDIVIDUAL AS HE FIGHTS THIS CHARGE. YES HE MIGHT NOT BE THE BRIGHTEST BULB IN THE BOX BUT HE IS A SECOND AMENDMENT BELIEVEING BULB.

All we know is that there was an MWAG call, and that a LEO stated he was wearing a shoulder holster with a vest over it. Until he goes to trial(if he goes to trial)we don't know what happened. Has anyone seen his cover garment? Carry rig? Or are we envisioning a 6'5" hairy monster in "Motor Cycle" apparel, tattooed and belligerent?
I ride an old 883 for fun and have a leather jacket with removable sleeves. When riding I use a shoulder holster for carry(hate the idea of a muzzle peeking out from below the hem of my jacket). When I park the bike, darn near the first thing I do is unzip that darn hot thing(this was pointed out to me by my bride, she read the article to find out why I was passing Cheerios and milk through my nose)it's so ingrained I didn't even realize that I do it. My carry weapon is still concealed, but I can envision situations(reaching for an item on the top shelf at the grocery store being one)where i could conceivably accidentally expose my gun.
Before we tar and feather this fellow let's at least have the facts in hand.
p.s. With few exceptions, the comments(many supporting open carry)posted to the story supported the alledged law breaker.

OK I got raked over the coals for my hasty response, but right now we don't have open carry. If the gear he was using to conceal was so flimsy that it did leave the firearm readily exposed for the world to see, then the way the law is currently implemented it is a black mark on on CHL holders.

Failure to conceal is unlikely to happen using a (gasp) fanny pack or other type enclosed holster.

Clearly, when I use my OWB plastic holster I employ a cover garment, but I'm always concerned about accidentally becoming unconcealed, but never when I use my rectangular pack.

That's my question, too. The statute clearly states the failure to conceal must be intentional. I guess the jury will have to make that determination if the DA presses for prosecution.
With all the recent reporting on gun violence (just yesterday, another today!), I can understand why store patrons would be skiddish. It irks me that the police officer didn't know the statute well enough to make sense of the situation.
