I assume that street criminals would prefer NOT to engage in a KNOWN gunfight when they can easily find a softer target.

Not necessarily true. If they think they can take you and some have good reason to think they can take you, then they don't care. It just adds to the story.

you are giving alot of criminals credit for being that smart

some are witty, most aint that bright. Hence their career choice.
