I was just answeing the question regarding the penalty. As far as having it in the car and not on your person, it doesn't have to be physically on you, it could be "on or about" you (within easy reach). Although the penalty has been removed, I still inform if I am carrying, even if is locked in the trunk of the car. But thats just me.

It is illogical a person with a CHL be required to inform a cop he has a handgun in his vehicle, while one without a CHL is not required to inform if a handgun is within.

Which begs the question in the case of a CHL holder: Is the purpose of the required disclosure to inform the officer of the driver's CHL status, or to give notice of the possible presence of a handgun?

If the latter, it certainly is somewhat discriminatory. although to no particular purpose. It's just kinda nosey IMHO.

Just another example of fixing the statutes bit by bit, piece by piece, over several sessions of the legislature.

Since getting my CHL I have had to present my CHL twice to officers for speeding. They both asked if I was carrying, I said yes both times, and both of them never acted any different than any other time I have been pulled over. They took my license walked back to the car came back and said slow it down have a nice day. They never asked to see the pistol they never asked where it was in the vehicle.

Worse is a felon doesn't have to answer the question. Fifth amendment rights.

Who is a bigger threat to a police officer? The CHL who doesn't want to get a speeding ticket or the criminal who doesn't want to go back to prison?
