To the other quote - I don't think all cops think motorcyclists are stupid. We have however worked a fair share of motorcycle fatality accidents. I don't think anyone could disagree they are dangerous. Someone stopping behind and leaving room could be a number of things. I like to leave room for the above reasons, AND it allows me to run multiple plates at the light.

I'm not anti-LEO but this stop comes a little too close to a civil rights violation IMO. 5 MPH over? Give me a break. You try going the speed limit for one day. By the way, I'm one of the motorcyclists out there and I am acutely aware that there are some really bad drivers out there. I see cars piling up almost daily.
I was doing the speed limit on I35 the other day in the left lane and a truck zipped past me giving a finger gesture out his back window. I would actually like to see more traffic law enforcement; but go after the real offenders.

It was my impression that you can be stopped for 1 MPH over. Even though that would hardly ever if any happen it's still within the officers rights to do that. Correct?

Yes, you can be pulled over for going one mile over the speed limit. The law is very clear on this. You cannot go faster than the speed limit without breaking the law and the violation is the same, whether it is 1 mph or 100 mph faster. I know exceeding the posted speed limit is only a prima facia case of speeding, but that would constitute probable cause for a stop and filing charges. While I would never do it, I have had to back up DPS on a traffic stop for 72 in a 70.

You dont realize how many drug busts and other "serious crimes" LEO get for doing the petty stops that most of ya'll complain on. That officer didn't violate any rights or do anything he couldn't or shouldn't do. Maybe some people should go through the citizen police academies and get a little more familiar to what the police actually do and why. There are usually two ways bad guys get caught, informants and traffic stops.

I like to watch those shows that come on Tru Tv showing various police officer stops via their dash cams. Most of those stops start with a simple speeding and turn into finding stolen property, drugs, multiple warrants, drunk drivers. I appreciate the officers being proactive and stopping people for the small things. Whatever their motive may be, they might just get one more bad apple off the streets, every criminal they take off our streets just makes it that much safer for the good citizens.

So, what if I may get stopped for something small? I am just grateful the officer is doing his job by checking to make sure I'm not a bad person. I may be 5 or 10 minutes later to my destination, but that's why I always get out of the house 10 minutes earlier than I could have.

I just don't see an infringement on anybodies rights here. Maybe it was a inconvenient hold-up... But, to me, the officer was simply doing what he is out there for.

I'd personally be a fan of them being allowed to pull you over for speeding, but not being able to write a ticket within 10 mph over the limit or so.

I think you will find VERY few that would ever write a ticket for anything less than 5 over. However, I did write one for 29 in a 25 once; it went from going to issue a verbal warning to a written warning to a ticket within the utterance of about 15 words from the driver. Wouldn't have stopped him originally, but it was close to a school and a lot of kids walking along the side of the road after school and he was not paying attention at all to his driving. Could have written it for careless and imprudent, but the speeding was cheaper and no points, so actually did him a favor.

I don't think the ticket for 2 over is 325.00.

If the officer decides he needs to give me a ticket for 2 mph over the limit after I have been courteous and cooperative then so be it. Yea, I may think it's pretty petty and I'm sure a lot of people will agree. When I get to court with it I will voice my opinion that I think the officer was maybe having a bad day and I think he was nit-picking. If the judge agrees and dismisses it then great, if the judge doesn't I will pay it and go on with life.
