...my 24-year-old once yelled "I'll call 911" when I was spanking him...he was about an angry 7 at the time...I said "Go ahead, here's something to tell him all about" and tore him up twice as much...his hiney clenched everytime I waved at that boy for at least 5 years after that...and he kinda forgot to call 911...he grew up to be a fine young man, husband, father, and just back from Iraq...musta scarred him for life...

Not that I don't agree with your opinion, but I don't think that your email will have any effect. The judge had to make the decision based upon the information presented in court. If she got another lawyer, the woman might have a chance to appeal based on the poor representation or incompetence of her previous lawyer.
The problem I really have with this isn't just that the judge ruled contrary to what the code says, but that she gave HER opinion about spanking to the woman she ruled against. And though a judge is certainly entitled to their opinion, castigating someone for doing something that ISN'T illegal by state code and is a common child-rearing technique in general society within this state, to boot, is simply WRONG. Besides, shouldn't a judge know the law, if they are going to render a verdict against someone based on it? Not mad at ya, just making it clear why I took the time to send the email. (Though I agree it was probably like talking to a brick wall to send it, ha ha.)

Heartland, I agree; FYI though; the judge is of the male, not female, persuasion.

Proverbs 13:24
New International Version (NIV)
24 Whoever spares the rod hates their children,
but the one who loves their children is careful to discipline them.

I hope this judge gets reprimanded in the near term, fired in the long term, and that somebody steps up to get this appealed.

Can you appeal when you plead guilty?

Good point. I don't know what recourse she might have. . .

Geeze, glad no one called CPS or the cops the time my 4 year old ran out in the middle of a parking lot with a car driving towards him (that stopped) while me and the wife were yelling at him to stop, when I caught up to him.
On a side note, my 4 year old doesn't run out in the middle of the road and stops walking/running when told to stop

IMHO.
We'd have fewer judges and "experts" who think spanking is wrong.

my husband read an article which said that a) the mom had previous cps issues and b) she did not have primary custody....sooooooo this goes alot deeper, although I think that what the judge said was idiotic, it may be that 'she' may not be allowed to spank..

Not usually, but she pleaded guilty to something that wasn't against the law. Judicial misconduct?
She had other problems, didn't have custody, but it sounds like the mother in law was looking for a reason.
