We don't know what his past record is. Maybe he had previous felonies and was already a three strike offender so any further offenses become maximum penalty automatically?

...could be...but I think they ACT on the third felony strike to incarcerate...maybe it was already in the courts and he figured he'd have a drink to celebrate his going away...
