I recall reading that the TABC requests an estimate of annual sales when a new licensee applies. The licensee cannot request one sign or the other. The TABC makes the determination based on % alcohol sales. But according to the OP this place sells no alcohol. The only penalty for a wrong sign of this sort is possible loss of license. If there is no license to lose, I don't see that anyone has any say as to what sign he has posted...

I'm not very familiar with the TABC laws. Is a 51% sign supposed to signify that the business has a license to sell alcohol? If the business has no such license, could they get in trouble for posting the sign because of that? I don't know. Just wondering.

I think the license is the only thing that can be held over their head for improper signage. I don't believe there is criminal penalties at all. If you don't have a license, I don't think they have a thing any leverage on you...

Some people (poorly informed ones) may try to use a 51% sign as a substitute for 30.06 and 30.07 signs. I surmise they may like it because the reference to a felony is scarier than what's on 30.06 and 30.07 signs. Of course the effort is ineffective, but if you don't know, you may find it tempting.

I'm sure that a business would do exactly that. I can take you to a restaurant that has a 51% sign up right now. On the TABC website, their listing says they should have the blue sign. I filed a complaint with the TABC a couple of months ago. Nothing changed. Either the TABC does not keep their website current and the status of that license has actually changed, or the TABC hasn't said anything to them about putting up the wrong sign.
I asked the manager about the sign, and she asked me if I was with the TABC. When I said no, she said this is the sign we are supposed to have, then turned and walked away quickly.
Do what you say you're gonna do.

Drop that off with the manager next time your there and tell her, well good to know you are right and TABC is wrong on what sign you have up.. I really like coming here and hate to see the company and management dragged in to court like that other place in (fictitious other place).
I heard the management team all got thrown under the buss by owners who claimed the actual on site day to day happenings were a direct responsibility of the managers.
