Re: Suggestion For New Law

My son had three pistols stolen, the perp was caught burglarizing a home about 3 months latter. He had one pistol on him the other in his vehicle and the other was found the perp's apartment with other stolen items from multiple burglaries. The one in the apartment was returned before trial as other evidence was sufficient, the other two were held until after trial (about a year later) because they were in his possession at the time of arrest and he was charged with assault of a law enforcement officer during the commission of a crime. They were returned after trial without problems and in good shape. Having the serial # kept him from having to file a new 4473. They did do a cursory phone background check while he was there to pick them up. This was in 09 or 10. In all cases they called him to see if he wanted them back. The officer told him that even if the gun/s had been involved in a shooting that he would have had the choice to get them back when they were done with the evidence. There was not a cost charged to him, as there should not have been. This was the Houston Police Dept. also.
