Yes, it's a bit of an extreme example, but, I'm on the side of illegal and should be charged. Position of authority trumps adult consent here, IMO.
Jail? If I'm on the jury I'd vote for probation (given what little facts are known), unless it wasn't the first time or the relationship started when the student was a minor or there was coercion.

A teacher from another school might fall into the same category if they are in a position to or threaten to exert influence via their relationship with the students teachers. Is a military officer allowed to have a relationship with any enlisted personnel, whether in the direct line of command or not? Wonder why not?

Counseling will be offered to the victim

I'm sure the only counseling the "victim" needs is to not brag about sexual relations he has had.

Seriously though I agree that unless the sexual relations started before he was 18 or he is a special needs student this is nothing more than a loss of employment.

Having been a Texas school teacher for 33 years, I can tell you that unless some form of penalty is invoked over and above losing her job, she will continue this behavior.

Texas school districts have been very bad about "passing the trash", i.e. allowing the "bad" teacher the choice of resigning or being fired. However, if they resign quietly, the school district will send a favorable performance letter on to the next school district they apply to. Who wouldn't resign under those circumstances? So the "bad" teacher goes on to the "unaware" new school district to teach probably the same type classes and start all over the "bad" things there were doing in the old school district. This happens every year in Texas.

The locker room talk is interesting. Would you feel the same way if it was a 50yo male teacher and an 18yo female student? How about a 50yo male teacher and a male student?

The law does not care if he was 21.

And the situation you describe would be illegal regardless of this law that we are discussing. Just like if a college professor had the same exchange with his/her student, or a manager had a similar exchange with their direct report. That would still be sexual harassment.

As long as he was still in high school and she was a teacher, age doesn't matter. Age also doesn't matter if you have sex with your step child, even though there's no particular genetic risk to potential offspring.
