On a serious note, I don't think he could be charged with both; there is assault, and there is battery. Once you committed battery, then the assault is gone (if I remember my laws correctly.)

Every state is different. Texas doesn't have a crime of battery (or mayhem).

The ones that I remember were more like fraternity paddles. They were probably something that the wood shop teacher worked up.

In Shirley, New York (Long Island), in June, a robber armed with a baseball bat tried to rob a deli. The deli owner, Mohammed Sohail, produced a shotgun. The robber dropped to his knees, wept, and begged for mercy. He even offered to convert to Islam.

Mr. Sohail gave him some cash and food and declined to press charges.

In Australia, a would-be burglar attempted to break into a house while carrying a Buzz Lightyear toy gun. The homeowner was not amused and shot him with a real shotgun.

I wonder how many hoops the homeowner had to go through to be able to keep that Shotty in the house. I had heard you couldn't even have evil shotguns in your domicile. intewesting...

I think non-semi-auto long guns are still OK in Australia. Those are the last to go. Even in the U.K. and Ireland, they can still own double-barrel shotguns.
