Since this topic of knives is so central to the issues of self-defense, I think a sub-forum devoted to these types of self-defense items would be justified.

Knives
Pepper Spray
tasers
canes
flashlights.....
are the things that come immediately to mind. What have I left out?

And what are the Mods opinions of adding a sub-forum to talk about these items?......just a thought.

What's the argument? As per Texas law, so long as you are CHLing, you can carry any knife as you see fit regardless they are legal knife or not or are carried concealed or not.

§ 46.02. UNLAWFUL CARRYING WEAPONS.

(b) Section 46.02 does not apply to a person who:

(1) is in the actual discharge of official duties as a member of the armed forces or state military forces as defined by Section 431.001, Government Code, or as a guard employed by a penal institution;

(2) is on the person's own premises or premises under the person's control unless the person is an employee or agent of the owner of the premises and the person's primary responsibility is to act in the capacity of a security guard to protect persons or property, in which event the person must comply with Subdivision (5);

(3) is traveling;

(6) is carrying a concealed handgun and a valid license issued under Subchapter H, Chapter 411, Government Code, to carry a concealed handgun of the same category as the handgun the person is carrying;

No, they do not define it. That is one of the problems with the law. That means the common definition is what controls it. The common definition could be anything from any fixed blade knife (a really non-knife person's definition) to the very speicifc definition a knife collector would use.

I think the courts will go somewhere in between, looking for a fixed blade knife with a clip point and the cross bar at the pommel, and a general appearance similar to the Bowie knife. for example, if you look at this page, you will find a group of knives that are all advertised as Bowie knives. The two points I made seem to be the only real common factors. I would include size, but since anything over a certain size is already banned that cannot be a factor here (one of the concepts of law is that it would not include unnecessary clauses).

The changes under the Motorist Protection Act apply to all weapons, not just handguns:

Sec. 46.02. UNLAWFUL CARRYING WEAPONS. (a) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun, illegal knife, or club if the person is not:
(1) on the person's own premises or premises under the person's control; or
(2) inside of or directly en route to a motor vehicle that is owned by the person or under the person's control.

I mentioned this in another post. I agree that, under the law, if we're CHL'ing, we should be able to carry a Full Katana in Wal-mart

However, I really don't feel like being the test case. Anyone else want to try it out for me?
