I don't believe Law Enforcement can arbitrarily confiscate firearms from your car in Texas either, no matter how "nutty" one is believed to be. Of course we can always allow them to do it by inaction. Apathy is why we are where we are today. These "precognitive" crime stopping statements from those in Government serving the People need instant consequences. What should be done is a new APD Chief.

Society can easily defend itself from Evil without instituting a "witch hunt" for gun owners. If the APD Chief were concerned about rampant crime in Austin maybe he should call a town hall meeting and have some firearms instructors and gun dealers on hand to teach & arm those gun-less morons that leave their very existence in the hands of others.

True. But I can see your on person weapon removed and perhaps not immediately returned. I would never consent to a search, the trunk for example, but would not resist if they did anyway. I wouldn't cooperate but wouldn't resist. Mainly note my lack of consent for the record.

GC §411.207. AUTHORITY OF PEACE OFFICER TO DISARM
(a) A peace officer who is acting in the lawful discharge of the officer’s official duties may disarm a license holder at any time the officer reasonably believes it is necessary for the protection of the license holder, officer, or another individual. The peace officer shall return the handgun to the license holder before discharging the license holder from the scene if the officer determines that the license holder is not a threat to the officer, license holder, or another individual and if the license holder has not violated any provision of this subchapter or committed any other violation that results in the arrest of the license holder.

It's worth the costs of that legal battle just to see them squirm.

I understand they are suppose to return your firearm (with a few exceptions), but those that believe they can vet (whatever that means) persons soley because they are gun enthusiasts may not always do so. The law is not always followed, even by law enforcement. My point is worse case you lose your carry weapon temporarily and will have to temporarily replace it from your stock at home.

Well, since my curiosity got the best of me, I decided to email the Austin PD and ask them what Chief Acevedo meant by using the word "vett"? I mentioned that I read it in a quote and also that I cannot remember anything in Texas law defining "vetting" in relation to firearms owners. I don't live anywhere near Austin and when I do occasionally go down that way, I take that nice toll by-pass around the place. We'll see if they even bother emailing me back (doubtful). On the off chance they do, I'll post the reply here on this thread.

I'm with Art on the part about if someone is really hateful and potentially dangerous that you should report them. I don't want to go back to McCarthy-ism, where if your neighbor tattles on you, you're labelled a "communist" and set to somewhere where the constitution doesn't apply.

For a a politician, which is what the job of police chief of a 1M person city is, his words are remarkably un-political.... Plus he's not recognizing that the nature of lone-wolves is that they don't have neighbors to report them, as they keep to themselves.

I think we should "improve" gun control.. And I recognize that I may get banned from this forum for having this opinion, but it's massively too easy to get firearms without any sort of check private-party to private-party. We should do something about that before the "antis" find the right issue to shove it down our throats and do it their way...

Who gets to decide if a Law Abiding American is "really hateful" and "potentially dangerous"? Many "really hateful people, groups and governments" believe anyone with a firearm is "potentially dangerous". Can Law Abiding Americans who own firearms turn them in or is this idea just pointing at us folks who own firearms?

A hundred gun laws will not deter a criminal from being a criminal. I imagine that many new Laws would turn most Law Abiding Americans into felons. Let the confiscation begin...

This is ironic in that statistically Texas CHL holders are more law abiding (lower arrest rate) than Texas police officers. Maybe we need to vet his force (sarcasm). This is not to disparage law enforcement, but to communicate that Texas CHL holders don't need any vetting.

When I lived in Austin, I heard many an Acevedo local interview where he states he strongly supports private gun ownership, but is strongly opposed to private transfer of firearms where no background check is involved.

Texas CHL holders have ALREADY BEEN vetted.
