I just spoke to DPS and here are the three options for submitting certified court documents.

1) Scan and submit exactly like submitting other supporting documents.
2) Fax using the letter received from DPS as a cover letter.
3) Mail to
Department of Public Safety
Attn. Eligibility
Box 4087 MSC 0245
Austin, TX 78773-0245

I just uploaded the certified court copies. I tried to read through, but it was all Greek to me. The only thing I could tell is that none of the arrests were "dismissed". They were all "non-suit" or "no formal disposition".

The illegal weapons arrest (potato gun at 15yo) looked like a finding of delinquent conduct with no sentence, so seems to me to be a finding of guilt. Lawyer says not to worry as its a misdemeanor from 20 years ago.

I'm still hopeful!

If you contact the DPS handgun licensing division and let them know you are actively pursuing their requests, they should give you at least one extension. Unless they have recently changed that position.

I am not a lawyer, but I believe a nonsuit is basically that charges were dropped aka, they chose not to pursue charging you on the arrests. So, should be same as a dismissal.

I called a few minutes ago to verify my upload was received in good order. They advised me to either fax or snail mail since uploads wouldn't be available to the tech for up to 6 weeks! Would've been good info to have when I called them yesterday to determine how to submit. Oh well. Now I'm working on getting them faxed.

Well, DPS can be a bit frustrating apparently.

First, they told me I could upload the court documents, so I did. When I tried to verify they received the documents, they told me I shouldn't upload them, only fax or snail mail.

Fine. So I asked them for the fax number. They said to use the fax number on the letter I received, using the letter as my cover page. Nope. The fax failed. I called the number and it just rings and rings. It's not even a fax number!

Finally, I call DPS to determine what the real fax number is and they tell me 512.424.5774.

Well, that probably is the fax number, but I can't confirm yet since its perpetually busy. I'll keep trying the fax until I get through.

I'm hesitant to mail them the original certified copies. It's obvious how disorganized they are and I don't want them to "misplace" them. Attorney said it only cost $13 to obtain the certified records, but actually locating the 20 year old docs from the Dallas archives was not an easy task.

I can only laugh at the ridiculousness of the situation since I only have myself to blame. If I was a good kid, none of this was an issue. My daughter is seven now and I'm starting to shudder at the thought of her being as much of a teenage pain as I was!

It keeps getting better. Called back to verify they have my fax. They said that faxes take 4-6 weeks to be processed and that they come in on a different floor of the building, the "Processing" department.

So I called the DPS operator and asked to be transfered to the "Processing" department. Operator said there isn't a processing department!

Finally, I called the licensing department back to figure out what number I call to have someone verify receipt of the fax. I got a very nice guy on the phone who looked me up and verified that, although he didn't know if the fax was there, the documents were successfully uploaded and available!

Now, I just play the waiting game again.

Update and good news!!!

As of this morning, I successfully cleared the background check and just waiting for printing!

My attorney is still going to submit the petition to permanently seal all records. That will prevent this headache when it comes time to renew since DPS won't be able to access the records.

Thank you all for the help and support!

Congradulations. Glad your persistance has paid off. Just out of curiosity. How much did this cost you?

Thanks. It cost a lot for an LTC, but not much as far as attorneys go. $1213, which includes the sealing, plus all the application and fingerprint fees everyone else has.
