That is a straw purchase.
I don't see it that way. IMHO, you bought it with your own money and then sold it to your buddy.
Unfortunately, the ATF does see it that way.

They're all about "intent": if you buy a gun not intending it to either keep it as your own gun, or a give it as a gift, ATF considers it a straw purchase.

The legislative intent behind straw purchases is preventing an eligible person from purchasing a weapon on behalf of an ineligible person.
Legislative intent doesn't mean squiddly to ATF. For entertainment, you should read 18 USC and the relevant portions of the CFR. You'll be scratching your head wondering how they read *this* and got *that*.

I''m sure you're right, and I realize that the form asks if you are buying the weapon for yourself.

As a practical issue, your buddy with the CHL is not likely to be arrested the next day and "give you up" to get leniency.

I've given up trying.

UPDATE:

So I picked up my dad's gun @ Gander Mtn. Friday and I'm so antsy wanting to give it to him right then that I almost couldnt contain myself. But I did good, I waited until midnight of the 3rd since his b-day was the 4th.

My mom and I had been shopping all day and he was sitting in the floor helping with some of the stuff we bought and I just casually went and snuck it out from under my bed at my parents' house. Then put it in his lap.He said "this better not be what I think it is b/c its too expensive".He opened it and yup thats what he thought it was.He was just drooling over it! Heck I think he slept with it that night.

All I know is hes showed it off to anyone who'll be still long enough to see it or hear about it.Plus I keep seeing him "petting it" and it reminds me of Gollum and The Ring...."my preciousssss".

So even though thats the only thing I coulld get him for his birthday I think I did good b/c I havent seen him grin like a little boy over a gift like that in my entire life. Mission complete.

I've never seen one of these in person so I went to look it up. I'd love to own a Henry one day. Your dad is a lucky guy. And personally I would go with just what you ordered, octogan/blued. It has more of a classic look to it if you ask me.

And he has peace of mind in knowing that his daughter is not only generous and thoughtful, but also knows firearms and is capable of taking care of herself. No easy victim here.
