A straw purchase, in legal terms, requires that the purchaser is buying a gun for a third party who would not be able to legally purchase that gun for themselves and who would not be able to successfully complete the 4473 for said purchase.
Just so that there is no confusion and no one gets in trouble, the above statement isn't entirely true. From an ATF Training scenario:
A straw purchase occurs even when the actual purchaser is not a prohibited person. The crime committed is knowingly making a false statement on the Form 4473 indicating that the straw purchaser is the actual purchaser, when this is not the case.

So, my husband sent an email to the store manager at Cabela's Fort Worth, Mr. Kevin Norwood.
Hi Kevin,
There is an interesting discussion going on, on the Texas CHL forum regarding one of your managers, Scott, and a female purchaser.
In full disclosure, I am the husband of the female purchaser and just feel that we have been wronged by Cabela's and Scott. I would appreciate you looking in to this for us for loyal customer who have spent $4,500 in the last two months and average close to $10,000 in purchases a year from your store. I am sure that my wife will be sending a formal letter to Scott and your attention as well.
The Forum website, if you wish to read, is at:

Thank you,
Brian
In just a little over an hour, we had the following response from Kevin, posted here with his permission:

Brian,
Thanks for the email. After reading what happened, it is apparent that we made a mistake in you and your wife's situation. I would hope that you understand how much pressure my team is under to protect everyones right to buy and sell guns. I can assure you we take it very seriously. We turn people away everyday that do not qualify and or try to make a straw purchase and yet still complain. In your case we got in wrong, not intentionally I assure you. If we lose our FFL license our store would close. We always err on the side of not selling if there is any doubt. Please allow me to get you another AR for your wife, it might take me a week or so but I'm sure we can make it happen. I hope you find this satisfactory and will continue to shop our store in the future. Don't hesitate to call me if you would like to discuss further, I will be back in the store tomorrow morning. Thanks again for the opportunity to correct our mistake.
Sincerely,
Kevin Norwood
Cabela's
Store Manager
And today, at 12:30pm, I came home with this:
We met with Kevin this morning so that he could have the opportunity to make things right, which he did. Kevin restored our confidence in Cabela's - and we walked out of the store as happy customers. Thank you to Kevin, and to the rest of the Cabela's gun department staff. You will be seeing a lot more of us!

Awesome. Glad they made things right. That bumps them up another few notches in my opinion, along with them pulling sponsorship from the Eastern Outdoors show after "assault weapons" and high capacity magazines were banned there.

Yes, they do a great job on a day to day basis and I am happy that they have corrected this. Saves from me having to drive over to Bass Pro.
Jennifer is all smiles again! Now, off to find some 308 ammo for me so we can go shoot.

I recommend updating the title of the thread to add "Update on Page 4" and the OP to say, "Situation resolved: see update on page 4!"
A lot of people know the headlines but may not read the whole thread.

She should have claimed discrimination on the basis of sex!

Edit:
Posted before the update title. Good to know Cabela's made it right.

Congrats to the OP!
That was very upstanding of the folks at Cabelas to do the right thing. It is amazing what a well-written letter will do (along with a little web exposure).

Seeing the M&P 15 reminded me that I saw the other day that Smith & Wesson also pulled out of that show

Awesome! Glad to see that the OP didn't just vent and let this go. A lot of respect to Cabela's for doing the right thing!

Love to read stories where corporations do the right thing after making a mistake. Bravo!
