You joke but it sounds like a good reason to write the Texas AG and explain the situation. Ask the AG's office to investigate the ISD for misappropriation of public funds or whatever fraud it would be for a private entity to steal tax dollars.sjfcontrol wrote:If the school is NOT a government entity, then DEMAND your tax money back!SlickTX wrote:... or have the right to raise funds through taxation??Purplehood wrote:If that were the case, how would a school district justify having a Police Department?ScottDLS wrote:You can't. Has been tried before by one of the forum members here. PISD attorney claimed they were not a governmental entity, which is patently false, but they won't take them down. If you were arrested for 30.06 for carrying in the parking lot you would have a decent case for false arrest.
Having a police department has nothing to do with being a government agency. The Catholic church has one at St. Mary's University in San Antonio. They are clearly not a governmental agency.Purplehood wrote:If that were the case, how would a school district justify having a Police Department?ScottDLS wrote:You can't. The reference to ISD's as a government entity is in the Government Code too. There seems to be something about Plano area government entities....city, ISD, county offices, police, etc. They just don't seem to want to acknowledge the state law.srothstein wrote:Having a police department has nothing to do with being a government agency. The correct question is how can they tax me if they are not a governmental agency? St. Mary's cannot, Plano ISD does.
EIDT: I see a few others thought of the taxation question before I got to.
Someone should send them a nice open records request regarding that...ScottDLS wrote:vernment entity is in the Government Code too. There seems to be something about Plano area government entities....city, ISD, county offices, police, etc. They just don't seem to want to acknowledge the state law.
