I see these as two different scenarios. One never said or indicated any affiliation or association and the other did. One was Muslim that committed terrorist acts and there are reports of al gaeda ties. Completely different in my mind.
I hold that these two are criminals and that their actions are not the same as treason. Remember, treason is well defined in the Constitution. Treason can bring the death penalty.

In this case I would like to see this one tried in federal court. The feds still have the DP.

With the amount of evidence he will be found guilty.

I doubt seriously if enhanced techniques will be necessary.

I can think of worse treatment than water boarding.

Having to listen to either obama, or hilary, or kerry, or pelosi, or feinstein, or bawney fwank......

Is he a citizen or legal permanent resident?

If not a citizen, then treat him as an enemy combatant? If a citizen, then treat him as a citizen? Will have to do a little more research to determine what his real status is as I've seen both reported.

One thing for sure......more lies and tricks by the left (Eric Holder)! :mad5
Ans: Home grown terrorism, senseless mass killer with no political affiliation. A monster who lost any sense of a human being. Defense team would claim he was a controlled dummy by his elder brother. A common trait in Eastern and Middle-Eastern siblings.

Official: Boston bombing suspect 'sedated'
By Chelsea J. Carter, CNN
updated 10:08 PM EDT, Sat April 20, 2013
Tsarni [the brothers' uncle] said he believes Tamerlan Tsarnaev influenced his younger brother.

FBI agents interviewed the elder Tsarnaev in 2011 at the request of a foreign government that suspected he had ties to extremist groups, the FBI said. It declined to name the government, but a senior U.S. official told CNN on Saturday that it was Russia that made the request of the United States.

The request was based on information that Tamerlan Tsarnaev was a follower of radical Islam, the FBI said, adding it found no evidence of terrorism activity.

"I think unless we see some horrible dropping of the ball, I don't think this is an intelligence failure," said former CIA operative Robert Baer. "In retrospect, it might look like one, but I don't think it is."
I included the last two sentences in the quote because it's a simply stunning example of newspeak spin-doctoring......."dropping the ball" apparently does not equal an "intelligence failure."

Hmmmmmm......

Both are citizens of US, living here in US since 2003. They are non-observant Muslims. In nutshell, they may know nothing about Islam but the word "Islam" itself. Their motive could be nothing but hate to the society that provided all opportunities that one seek in life. Their wicked murderous act is nothing but pure evilness.

As for elder brother, he may expressed extremists views which still protected under the 1stA. However, NSA should have kept watching him with owl's eyes. His visit to Russia for 6 months should have resulted to an extend interview at the airport of entry.

Pretty concerning when the Russian intelligence service notifies the US 2 years ago about how extremist the older brother was...

Drinking alcohol and having kids out-of-wedding is not that religious. Once that has to remember that Extremists would like to recruit the religiously ignorant and feed them their hateful propaganda, keep them ignorant about the religion, and drive them to be a self-destructive killing machine, void of any humanity.

Judge Nap makes a strong Constitutional argument. Note he mentions he is speaking of the younger killer and not his older brother.

Brothers assassinated police officer for his gun. They were one pistol short.

Officers lockable holster prevented them from getting it.

But non the less a police officer died as a secondary result of strict gun control.

Probably won't hear that analysis anywhere.
