Howdy Fellas,

I saw a restaurant post 30:05, 30:06, and 30:07 at the same time. I’ve never seen all three posted at an entrance at the same time. With this signage, can a Texas CHL holder legally enter?

A CHL holder cannot enter concealed or open because they have the 30.06 and 30.07 sign posted. The 30.05 takes care of those who do not have CHL’s.

There's a somewhat esoteric argument that even the 30.05,6,7 trifecta of properly posted signs could still provide a loophole for a LTC holder.

However, a better argument exists for a location posted only 30.06/7 that a LTC could still carry there. It goes as follows.

Sec. 30.06. TRESPASS BY LICENSE HOLDER WITH A CONCEALED HANDGUN.
(a) A license holder commits an offense if the license holder:
(1) carries a concealed handgun under the authority of Subchapter H, Chapter 411, Government Code, on property of another without effective consent; and
(2) received notice that entry on the property by a license holder with a concealed handgun was forbidden.

The offense occurs when you carry "under the authority" of your LTC. Since without a 30.05 you don't require the authority of your LTC, it makes no sense that you would commit the offense simply because you HAVE your LTC. How about a police officer on or off duty, who happens to have an LTC? Are they committing an offense too?

As a practical matter it is irrelevant because no one is going to know if you have a LTC, or a gun for that matter. Or in the case of a police officer, even if they do find out, there is nothing the can (legally) do about it.
