protecting my pet

I'm assuming it's ok to use lethal force to protect my pet. Say a big dog is attacking my chihuahua, say "bye bye" to big dog. Also to prevent someone from actually stealing my dog, I'm protecting my property (PC 9.42).

I suppose we all have a different set of values.

Depending upon the circumstances, you might get off with no problem, or you might be prosecuted for various offenses.

So quick question.....if someone is trying to rip off your dog or cat.....you can pull to warn/scare and possible fire to stop them if they dont after seeing the business end of a firearm?

Let's sort this out.
Stealing an animal is theft. Legally, it's no different from stealing a lawn ornament.
- If the thief is taking the animal out of your yard in the day time, it is simple theft, and use of deadly force is not justified.
- If it is theft in the night time, and use of deadly force is justified.
- If you confront the thief, and he threatens you, it becomes robbery, and use of deadly force is justified.
- If you are present with the animal, and the thief threatens you, it is robbery, and use of deadly force is justified.

I don't like rules like that because then whats the whole point? If a badguy knows that during the day someone can't use legal force during a theft you might as well give him cookies and open the front gate so he can leave your yard. Or at least help him carry your new lawn ornaments or lawnmower to his car.
I'm sorry but I'm pulling a gun. I can almost guarantee that if its between being shot and getting a free dog or cat the BG is almost always going to drop the animal and run or give up.

Oh, you can use "Force," just not "Deadly Force."
