Houston has a good record on the Castle Doctrine. If they are looking for a test case, we have it here.

Is it just me or did that reporter completely miss the "Castle Doctrine" intent?

Yea, she really didn't state clearly what the Castle Doctrine actually states. What she said isn't necessarily bad, however. If people think that there is a law that allows people to protect there property indiscriminately, then hopefully, he won't be crucified by the public as a gun-wielding killer.

Not that he would be portrayed in that sense, but it's not necessarily a bad thing to have misinformation in support of the guy, rather than misinformation against him. You know, calling anything that looks cool and has a clip of bullets an "assault rifle".

The only Texans who think it's a bad idea to shoot burglars are burglars and their relatives.

As someone who moved here as an adult, I find this remarkable and commendable.

I agree it seems like the person committing the crime is always such a great guy in the eyes of family members and loved ones,i guess they look at burglary and robbery as being gainfully employed in their chosen profession, the work related injuries seem to be on the rise i'm waiting for the day they try to get work comp fer getting shot during a home invasion etc.

I remember hearing about this, but I'm not sure of the credibility of the story, where a would-be burglar is creeping on the roof of somebody's house, and peers in through a sky light. The sky light breaks, and the burglar falls through the ceiling and breaks a bone or lands on something sharp, or whatever, and sues the homeowner... and actually wins! Another vairation is where he falls off of the roof and injures himself, etc. Did this actually happen? A little off-subject, I know, but that workman's comp statement brought it to mind.

I'm pretty sure that has actually happened.

The liability laws of some states make a property owner liable for everything that happens on the property, regardless of whether the person had a right to be there. Maybe these laws have been changed. I've been reading newspapers for 40 years and can't site a source.

Crooks cannot claim workers comp. Workers comp is paid for by employers. Self-employed people are not eligible for it. Now maybe the mafia ...

The only case I'm sure of happened in the UK. A teenager with a record of burglery was climbing on a factory roof in Liverpool and fell through a skylight. He won his case and collected damages against the owner.
